R-O1-81 <br /> <br />RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT <br />APPLICATION TO THE CHESAPEAKE BAY LOCAL ASSISTANCE <br />DEPARTMENT FOR FY 2003. <br /> <br /> WHEREAS the Chesapeake Bay Preservation Act is set out in Title 10.1, <br />Chapter 21 of the Code of Virginia and establishes that the Chesapeake Bay Local <br />Assistance Board is responsible for carrying out the purposes and provisions of <br />said Act, and <br /> <br /> WHEREAS the Chesapeake Bay Local Assistance Board has <br />promulgated a Request for Proposals to the Local Assistance Competitive Grants <br />Program to assist localities in offsetting the costs of Chesapeake Bay Act program <br />development and Chesapeake Bay Act implementation and enforcement; and <br /> <br /> WHEREAS, the City's Department of Planning and Inspections desires to <br />apply for grant funds to contract the specialized consultant services necessary to <br />complete the required Chesapeake Bay Preservation Act component of the <br />Comprehensive Plan update. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City <br />of Portsmouth, Virginia, that it does hereby endorse an application for a grant in <br />the amount of $50,000 from the Chesapeake Bay Local Assistance Department <br />for the purpose of updating and completing the Chesapeake Bay Preservation Act <br />component of the City's Comprehensive Plan. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be authorized on <br />behalf of the City of Portsmouth to submit said application for the grant and to <br />sign all necessary documents related to the grant certifying compliance by the <br />City of Portsmouth with the appropriate regulations governing the administration <br />and use of grant funds. <br /> <br /> BE IT FURTHER RESOLVED, that if the grant is awarded, the City of <br />Portsmouth hereby agrees m pay for full costs (in-kind) of the grant project, not to <br />exceed, $50,000 in total costs, providing that certain of these costs are subject to <br />grant reimbursements totaling $50,000, which shall he payable from the <br />Chesapeake Bay Local Assistance Department in accordance with a contractual <br />agreement to be executed between the City of Portsmouth and the Chesapeake <br />Bay Local Assistance Department, and that, if the City of Portsmouth <br />subsequently elects to cancel this project, the City of Portsmouth agrees to <br />reimburse the Chesapeake Bay Local Assistance Department for the total amount <br />of funds expended by the Department through the date the Department has been <br />notified of such cancellation. <br /> <br /> <br />
