<br />At a regular meeting of the City Council, held o~ April 28, 1964, there were present:

<br />R. Irvine Smith, Jack P. Barnes, John L. Dillon,. L. L. Knight, W. T. Leery, A. P. Johnson, Jr.,
<br />City Manager, and M. A. Kerb, Jr., City Attorney.
<br />
<br />The meeting was opened with Prayer by Mr.~ Dillon.
<br />
<br />approved.

<br />Minutes of regular meeting of April 14 and called meeting of April 16,
<br />
<br />The following reports from the City. Manager were read
<br />
<br />1964, were read and
<br />
<br /> 64-82 - "I submit the attached agreement between the City of Suffolk and the City of Portsmouth
<br /> and recommend the proper city officials be authorized to. stg~n
<br /> This agreement covers office space to be used by the Portsmouth Water Department in the new
<br />Municipal Building now ~being constructed by the City of Suffolk~
<br /> There will be no rent for this office space paid by the Portsmouth Water DePartment but in
<br />return, the water deparsmenz will collect sewage disposal fees for the CitE of Suffolk.
<br /> At the present time,, .the water departmen% office is in a converted residence and when the water
<br />department offices are moved, I wit~l recommend that this property e e~sposen ox. ·
<br />
<br /> Motion of ~r. DillOn that the proper city o~ficials be authorized ~o sign the~.ag~gement was
<br />adopted, without dissenting vote..
<br />
<br /> 64-83 - "I submit the attached ordinance and ~recommend it be placed' ~n first reading.
<br /> This appropriates $5,000.00 from the bend fund for the completion of the water storage sank at
<br />Airline Boulevard and Victory Boulevard.
<br /> This additional appropriation covers the installation of an additional t%ye~ty inch valve on the
<br />main line extending from the tank a~d fencing of the tank area, also the cost of transmitting~ and recording
<br />instruments that were not included in our originalestimates' ."

<br />dissenting vote:

<br /> "AN ORDINANCE TO APPROPRIATE $5,000:00 FROM-THE BOND FUND FS~ THE PURPOSE OF
<br /> COMPLETING CONSTRUCTION OF A WATER STORAGE TANK"
<br />
<br /> 64-84 - "I submit the attached resolutfon and recommend its adoption.
<br /> This resolution appoints viewers for the closing of Bangh Road which has been ~equested ~by the
<br />Virginza Electric and Power Company.
<br /> The power comp~any is requesti~ng the closing of this road in order that they might install s tower
<br />
<br />Motion of Mr. Dillon to adopt the resolution.
<br />
<br /> On mot.ion or'Mr. Barnes, the motie~..~s~amended toinclude the following names ~f viewers:
<br />Graydon D. Meginle~, L. A. Clark, James V. McGehee, Prank H. Bilisoly, and Charles R. Lively.

<br />Vote being taken, the resolution as amended was adopted as follows:
<br />
<br /> "WHEREAS, Norfolk and Portsmouth Belt Line Railroad Company, Norfolk Veneer Mills, Inc., and
<br />Virgi.nia Electric and Power Compsny have made epplieation ~o vacate, clo~e and discontinue all that portion of
<br />Baugh's Road begimling a~ a point 1,027 feet West of the Norfolk and Portsmouth Belt Line Bridge ~est abutment
<br />to n point 1,429 feet West of the same abutment, and it appearing that notice of the application a~d request for
<br />the appointment of viewers was duly posted on the first day of the term of court of the Court of Hustings for
<br />the City of Portsmouth, Virginia, held on the 16th day of April, 1964, on the bulletin board of the Court of
<br />Hustings for the City of Por~smeuth, on the b~lletin board 'of the City Sergeant's Office ~n the City of
<br />Portsmouth, and as the intersection of Bsugh's Road and Route 337, at least five days priQr to this meeting:
<br /> NOW, TI{EREFORE, BE IT RESOLVED h~ the Council of the City of Portsmouth, Virginia, that:
<br />Graydon D. Meginley, L. A. Clark, James V. McGehee, Frank H. Bili~o}y, and Charles R. Lively be appointed viewers
<br />to view said stree~ and report ~o this Council in writing whether ~n their opinion, any, and if any, what
<br />· nconvenience would result from discontin~in~ t~ne aforementioned portion of Baugh's Road."
<br />
<br /> 64-85 - "I submit the attached ordinance and recommend it be placed on first reading.
<br /> This ordinance amends the License Tax Ordinanc~ pertaining ~o license ~sxes when no~ previously
<br />in business a full year.
<br /> Under the r~ling of the state ~nx commissioner, the commissioners of revenue have been advised
<br />that under the wording of our License Tax Ordinance, a developer or contractor would have to pay s license tax
<br />based on the full cost of his development for each year that it is under construct±on.
<br /> Under the proposed ordinance, he would only buy ~ business license based on the to%al of the
<br />con~ract and not pay a license Eax each year on the total of the contrac~ while under construction."
<br />
<br />On motion of Mr. Leery, the following ordinance was approved on first resding~, without dissenting
<br />
<br />vote:
<br />
<br />"AN ORDINANCE TO AMEND SECTION 10 OF ARTICLE I OF THE LICENSE TAX ORDINANCE
<br />OF THE CITY OF PORTSMOUTH, 196Q,-PERTAINING TO LICENSE TA~ WHEN NOT PREVIOUSLY
<br />IN BUSINESS A FULL YEAR"
