Au,qust 24, 1999 UP-99-10 Beginning at a point 1,427'+ west of the intersection of Airline Boulevard and Ballard Avenue; thence, in a southerly direction 320'+ to a point; thence, in a westerly direction 150'+ to a point; thence, in a northerly direction 350'+ to a point; thence, in an easterly direction 150'+ to a point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) The occupancy of the daycare facility shall be limited to no more than one hundred nineteen (119) children. (b) The age range of the children shall be from three to five years of age. (c) Children must be participants in the Head Start Program. (d) Indoor hours of operation shall be limited to the hours between 7:30 a.m. to 6:30 p.m. Monday through Friday. Outdoor play hours shall be limited to between 8:00 a.m. to 6:00 p.m. (e) The outdoor play area shall be enclosed with a fence at least four feet high. (f) The applicant must maintain at least (8) on-site spaces for staff parking. (g) All students must be bused to the site. (h) The facility shall comply with the submitted floor plan (Exhibit A) and site plan (Exhibit B) dated June 28, 1999. (i) The facility shall comply with the submitted building elevations (Exhibit C). (j) The facility shall submit to all required inspections by the City's Fire Prevention Bureau, Public Health Department and Building Official. (k) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (I) All taxes and fees in connection with the subject property and operation shall be paid in a timely manner. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 99-188(b): "A RESOLUTION GRANTING A USE PERMIT TO RICHARD AND SHARON ATKISON TO OPERATE A RESTAURANT AND TWO APARTMENT UNITS AT 446 GREEN STREET. WHEREAS, Richard and Sharon Atkison have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use permit to operate a restaurant and two apartment units at 446 Green Street, Portsmouth, Virginia; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for an amended use permit with conditions.
