Au,qust 24, 1999 <br /> <br />UP-99-10 <br /> <br /> Beginning at a point 1,427'+ west of the intersection <br />of Airline Boulevard and Ballard Avenue; thence, in a <br />southerly direction 320'+ to a point; thence, in a westerly <br />direction 150'+ to a point; thence, in a northerly direction <br />350'+ to a point; thence, in an easterly direction 150'+ to a <br />point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The occupancy of the daycare facility shall be limited to no more <br />than one hundred nineteen (119) children. <br /> <br />(b) The age range of the children shall be from three to five years of <br /> <br />age. <br /> <br />(c) Children must be participants in the Head Start Program. <br /> <br /> (d) Indoor hours of operation shall be limited to the hours between 7:30 <br />a.m. to 6:30 p.m. Monday through Friday. Outdoor play hours shall be limited to <br />between 8:00 a.m. to 6:00 p.m. <br /> <br />(e) The outdoor play area shall be enclosed with a fence at least four <br /> <br />feet high. <br /> <br />(f) The applicant must maintain at least (8) on-site spaces for staff <br /> <br />parking. <br /> <br />(g) All students must be bused to the site. <br /> <br /> (h) The facility shall comply with the submitted floor plan (Exhibit A) and <br />site plan (Exhibit B) dated June 28, 1999. <br /> <br /> (i) The facility shall comply with the submitted building elevations <br />(Exhibit C). <br /> <br /> (j) The facility shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. <br /> <br /> (k) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (I) All taxes and fees in connection with the subject property and <br />operation shall be paid in a timely manner. <br /> <br /> REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />99-188(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO RICHARD AND SHARON <br />ATKISON TO OPERATE A RESTAURANT AND TWO APARTMENT UNITS AT 446 <br />GREEN STREET. <br /> <br /> WHEREAS, Richard and Sharon Atkison have made application pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use <br />permit to operate a restaurant and two apartment units at 446 Green Street, <br />Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of <br />the application for an amended use permit with conditions. <br /> <br /> <br />
