<br /> WHEREAS, Associated Naval Architects, Incorporated, submitted a proposal to purchase the
<br />~roperty~an~_existing improvements for the sum of Three Hundred Dollars ($300,00) and committe
<br />to make a capital expenditure on the land and pier in excess of Thirty Thousand Dollars ($30,0
<br />to include demolition of pedestrian walkway, fender piling, fencing and installation of utilit
<br />required for lighting and other services and to use the property as a pier structure for use
<br />in connection with maritime related industry including boat and ship repair activities; and
<br />
<br /> ' WHEREAS, the City Council has determined that the hereinafter property is excess to
<br />the requirements of the City; and
<br />
<br /> WHEREAS, the City Council has determined that the proposal of Associated Naval Architects
<br />Incorporated¥ is the best use to which said property may be adapted.
<br />
<br /> NOW, THEREFORE~ BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be,' and he hereby is, authorized to convey all right, title and interest
<br />of the City of Portsmouth in and to the hereinafter described property to Associated Naval
<br />Architects, Incorporated:

<br /> thereon, and the appurtenances thereunto belonging, bounded and described
<br /> ~ a·s fQ~W~ ~eginning at a point on the eastern side of West Norfolk
<br /> Road (Third Avenue) 290' south of the southeastern intersection of West
<br /> Norfolk Road and ~hip~right Street (formerly Washington Street), as layed
<br /> out on the Map of West Norfolk, made by Grimes and Hargroves, in the year 1889,
<br /> recorded i~ ~he Clerk's Office of the Circuit Court of the City of Chesapeake,
<br /> Virginia, 'thence, easterly and at right angles to said West Norfolk Road 25';
<br /> thence, parallel with said West Norfolk Road and southerly to the Port Warden's
<br /> line in the Elizabeth River; thence, westerly along said Port Warden's line
<br />,~. · 25', more or less, to the eastern side of West Norfolk Road; thence, northerly ~
<br /> along the eastern side of West Norfolk Road to the point of beginning, to-
<br /> gether with all the water privileges, riparian rights and appurtenances in
<br /> any way appertaining or belonging to said land.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />such documents a~ ~may~ be necessary to complete this transaction."

<br /> 79-215 "Consideration of a resolution authorizing the City Manager ~o enter into an
<br />ag-reement wi~h the Seaboard Coast Line Railroad for use of property on Godwin Street.
<br />
<br /> The Seaboard Coast Line Railroad has vacated their track adjacent to our Godwin Street
<br />complex. In order for us to retain our siding and continue to use a strip of railroad propert
<br />that ~s inside our fence, we need the attached agreements signed and attached Council resolutim
<br />passed. The City Manager recommends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopted~
<br />and by the following vote:
<br />
<br />"A RESOLUTION AHTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH
<br />SEABOARD COAST LINE RAILROAD COMPANY FOR USE OF PROPERTY ON THE EAST SIDE
<br />OF GODWIN STREET.
<br />
<br /> WHEREAS, the City of Portsmouth has had the use of a portion
<br />gailroad Company's side track and certain other facilities on the
<br />1974 for ~he purpose of offloading, s~or~ng and handling drainage
<br />and
<br />
<br />of the Seaboard Coast Line
<br />east side of Godwin Street
<br />pipe and other materials;
<br />
<br /> WHEREAS, Seaboard Coast Line Railroad Company has vacated the track located in this area
<br />of the City of Portsmouth; and
<br />
<br /> WHEREAS, in order to continue to have use of the siding for deliver)-
<br />materials the Ci%y-and Seaboard Coast Line Railroad Company have arranged
<br />of thi~ siding for the exclusive use of the city of Portsmouth.

<br />Street."

<br /> 79-2~6 ~- "Consideration of a motion transferring $32,500 from the Capital Improvements
<br />Fund project 333 Street Improvements, Deep Creek Boulevard from Des Moines Avenue to Wright
<br />Street to projects 1006 and 1015 Elm Avenue Street and Drainage Project and the Lawrence
<br />Stadium Outfall.

<br /> $17,500 will be transferred to the Elm Avenue Drainage Project and the balance to the
<br />Lawrence Stadium Outfall. The City Manager recommends adoption."
