November 13, 1979 <br /> <br /> At a regular meeting of the City Council held on November 13, 1979, there were present: <br /> <br /> Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. Saunders Early, Jr., <br /> J. Robert Gray, James W. Holley, III, Edward L. Oast, Jr., Robert T. Williams, <br /> City Manager, Gordon B. Tayloe, Jr., City Attorney. <br /> <br /> Rev. James R. Murphy, Pastor, Congregational Christian Assembly, opened the meeting with <br />.p~ayer,. followed by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Davis welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Beamer, minutes of the <br />October 23, 1979; minutes of the regular meeting of October 23, i979, <br />received, and was adopted by unanimous vote. <br /> <br />called meeting of <br />to be approved as <br /> <br /> 79-400 Councilmen Early, Beamer, Gray and Oast on November , 1979 attended the celebra-I <br />tion "Fall Festival Day" on the USS John F. Kennedy, and Councilman Early was presented by the <br />Captain of the USS John F. Kennedy a picture of the Kennedy, with the following inscription, <br />"For: City of Portsmouth Thank you for your help in making the J. F. Kennedys' stay in Ports- <br />mouth a pleasant one. L. R. Myers, Commanding Officer, 11/7/79" <br /> <br /> 79-401 The following Certificate of Appreciation was presented to Frank N. Bilisoly, <br />as Chairman and Street Closing Coordinator for twelve years: <br /> <br /> "WHEREAS, Frank N. Bilisoly has served as a member of the panel selected as viewers for <br />street closing in the City of Portsmouth for twelve (12) years, contributing much time and <br />talent to the projects and programs of benefit to the citizens of. the City of Portsmouth and <br />the City government; and <br /> <br /> WHEREAS, during this time of service, Mr. Bilisoly has been responsible for muc~ of the <br />coordination and successful completion of the tasks assigned to this panel of viewers by the <br />City Council; and <br /> <br /> WHEREAS, the City Council recognizes that dedicated and unselfish service involves <br />personal sacrifices and inconveniences. <br /> <br /> NOW,. THEREFORE, the Council of the City of Portsmouth, <br />grateful appreciation of the citizens of Portsmouth and the <br />for the services rendered to this community." <br /> <br />Virginia, hereby extends the <br />City government to Frank N. Bilisol <br /> <br />79-402 <br /> <br />A PUBLIC HEARING WITH RBSPBC% Y~ A.PROPOSBD AMENDMJgNT-TO_.$ECTtON 5.01 <br />CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA: <br /> <br /> "A Public Hearing at the City Council Chambers of the Municipal Building of the City of <br />Portsmouth, No. 1 High Street, will be held on November 13, 1979, at 7:30 p.m., at which time <br />citizens shall have the opportunity to be heard on a proposed amendment to Section 5.01, Charte <br />of the City of Portsmouth, which proposed amendment is hereinafter set forth: <br /> <br />Section 5.01. Appointment, qualifications, etc. <br /> <br /> That the City Manager shall be the Administrative and Chief Executive Officer of the <br />Municipal Government. He shall be chosen by the Council without regard to his political belief <br />and solely upon the basis of his executive and administrative qualifications. The choice shall <br />not be limited to inhabitants of the City and State. The City Manager ~Aall receive such com- <br />pensation as shall be provided by the Council by Ordinance. He shall be appointed for an in- <br />definite period, and shall serve at the pleasure of the Council. In the event of the inability <br />of the City Manager to temporarily perform the duties of his office by reason of absence, <br />vacation, sickness or other disability, the City Manager shall designate someone to perform <br />the duties of his office during such absence or disability, and if the City Manager shall <br />permanently be unable to perform the duties' of his office, the City Council shall designate <br />someone to perform the duties of said office." <br /> <br />No one spoke. <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Early, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND THE CHARTER <br />OF tHE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, Sections 15.1-835 and 15.1-912 of the Code of Virginia, 1950, as amended, provide <br />for the amendment of the City Charter upon the holdiAg of a public hearing and the request of <br />the City Council to the General Assembly; and <br /> <br /> WHEREAS, the City Council is of the opinion that a certain amendment to the Charter of <br />the City of Portsmouth is necessary and is desirable at this time and has held the public <br />hearing required by law to consider such amendment. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Attorney is hereby directed to prepare and transmit to the General Assembly, together <br />with certified copies of this Resolution, a draft of a bill amending the Charter of the City <br />of Portsmouth, 1970, as follows: <br /> <br />Section S.O1.
