April 7~ 1980 <br /> <br />At a Public Hearing of the City Council, held on April , 1980, there were present: <br /> <br />Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. <br />J. Robert Gray, Edward L. Oast, Jr., Robert T. Williams, <br />Lieberman, City Attorney. <br /> <br />Saunders Early, Jr., <br />City Manager, Steven <br /> <br />Absent: James W. Holley III <br /> <br />80-122 Public Hearing on rezoning and use permit applications: <br /> <br />(a) Zoning Petition Z 80-1 Petition of Azalea Realty & Development Corporation, <br /> by F. M. Jones, President. <br /> <br /> Robert F. Babb, Attorney, representing F. M. Jones, spoke for the petitioner and that <br />the property to be rezoned to C-2. <br /> <br /> On motion of Mr. Early and seconded by Mr. Beamer, to concur in the recommendation of <br />the Planning Commission, the following ordinance was approved on first reading, and by un- <br />animous vote: <br /> <br />'ZONING AMENDMENT ORDINANCE Z 80-1" <br /> <br />(b) Zoning Petition Z 80-2 Petition of Carlton B. ~ Rebecca L. Cavender and <br /> Harold C. & Virginia A. Hacker, Owners. <br /> <br /> Mrs. Virginia Hacker, Co-owner, 407 Robin Road, requested that the property to be <br />rezoned to C-1 or C-2. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, to concur in the recommendation of the <br />Planning Commission, the petitian to be denied. <br /> <br /> Substitute motion of Mr. Gray and seconded by Mr. Beamer, the petition to be deferred <br />until the meeting of May 13, 1980, and was adopted by unanimous vote. <br /> <br />(c) Zoning Petition Z 80-4 Petition of the City Planning Commission by Planning <br /> Director J. Brewer Moore. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Early, to concur in the recommendation of <br />the Planning Commission, the following ordinance was approved on first reading, and by un- <br />animous vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 80-d" <br /> <br />(d) Zoning Petition Z 79-18 Petition of Raymond Smith, Owner. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, the petition to be referred back to the <br />Planning Commission for further consideration upon the recommendation of the City Attorney,and <br />was adopted by unanimous vote. <br /> <br />(e) Use Permit 79-2 <br /> <br />Use Permit application of Marie Harris <br />granted by C~ty Council on May 8, 1979, <br />number of children who may be enrolled <br />Tender Loving Child Care Center at 276 <br /> <br />to amend permit <br /> to increase the <br />at any one t~me at the <br />Elm Avenue. <br /> <br />Ms. Marie Harris, Petitioner, spoke in support of the use permit. <br /> <br /> On motion of Mr. Beamer and seconed by Mr. Gray, to concur in the recommendation of the <br />Planning Commission, UP 79-2 to be amended and was approved on first reading, and w~s adopted <br />by unanimous vote. <br /> <br />On motion meeting adjourned. <br /> <br />APPROVED - <br /> <br /> <br />
