April 7~ 1980 At a Public Hearing of the City Council, held on April , 1980, there were present: Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. J. Robert Gray, Edward L. Oast, Jr., Robert T. Williams, Lieberman, City Attorney. Saunders Early, Jr., City Manager, Steven Absent: James W. Holley III 80-122 Public Hearing on rezoning and use permit applications: (a) Zoning Petition Z 80-1 Petition of Azalea Realty & Development Corporation, by F. M. Jones, President. Robert F. Babb, Attorney, representing F. M. Jones, spoke for the petitioner and that the property to be rezoned to C-2. On motion of Mr. Early and seconded by Mr. Beamer, to concur in the recommendation of the Planning Commission, the following ordinance was approved on first reading, and by un- animous vote: 'ZONING AMENDMENT ORDINANCE Z 80-1" (b) Zoning Petition Z 80-2 Petition of Carlton B. ~ Rebecca L. Cavender and Harold C. & Virginia A. Hacker, Owners. Mrs. Virginia Hacker, Co-owner, 407 Robin Road, requested that the property to be rezoned to C-1 or C-2. Motion of Mr. Barnes and seconded by Mr. Gray, to concur in the recommendation of the Planning Commission, the petitian to be denied. Substitute motion of Mr. Gray and seconded by Mr. Beamer, the petition to be deferred until the meeting of May 13, 1980, and was adopted by unanimous vote. (c) Zoning Petition Z 80-4 Petition of the City Planning Commission by Planning Director J. Brewer Moore. On motion of Mr. Gray and seconded by Mr. Early, to concur in the recommendation of the Planning Commission, the following ordinance was approved on first reading, and by un- animous vote: "ZONING AMENDMENT ORDINANCE Z 80-d" (d) Zoning Petition Z 79-18 Petition of Raymond Smith, Owner. Motion of Mr. Barnes and seconded by Mr. Gray, the petition to be referred back to the Planning Commission for further consideration upon the recommendation of the City Attorney,and was adopted by unanimous vote. (e) Use Permit 79-2 Use Permit application of Marie Harris granted by C~ty Council on May 8, 1979, number of children who may be enrolled Tender Loving Child Care Center at 276 to amend permit to increase the at any one t~me at the Elm Avenue. Ms. Marie Harris, Petitioner, spoke in support of the use permit. On motion of Mr. Beamer and seconed by Mr. Gray, to concur in the recommendation of the Planning Commission, UP 79-2 to be amended and was approved on first reading, and w~s adopted by unanimous vote.
