May 27, 1980 <br /> <br />At a regular meeting of the City Council held on May 27, 1980, there were present: <br /> <br />with <br /> <br />Richard J. Davis, Jack P. Barnes, Ben A. Beamer, Sr., E. Saunders Early, Jr., <br />J. Robert Gray, James W. Holley, III, Edward L. Oast, Jr., Robert T. Williams, <br />City Manager Steven Lieberman, City Attorney. <br /> <br />Councilman Ben A. Beamer, Sr., Minister, Ebenezer Baptist Church, <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br />opened the meeting <br /> <br />Mayor Davis welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Gray and seconded by <br />1980; minutes of the regular meeting of <br />adopted by unanimous vote. <br /> <br />Mr. Barnes, minutes of the called meeting of May 13, <br />May 13, 1980, to be approved as received, and was <br /> <br /> 80-164 Public Hearing on proposed group housing project application, GHP-80-2, River <br />Shore Apartments, deferred from the meeting of May !3, 1980, was held: <br /> <br /> Philip Richardson, Applicant-Developer, representing Urban Developers, Inc., 3330 <br />Pacific Avenue, Virginia Beach, spoke in favor of the project and requested approval of <br />GHP-80-2. <br /> representing Merrifields Civic League, <br /> Fred Baule, 4100 Tarnywood Drive,/spoke in opposition of the project. <br /> Don Comer, 4627 River Shore Road, spoke against the project and requested that the <br />permit be denied. <br /> Brad Cherry, 4520 Wake Forest Road, spoke in opposition of the proposed project because <br />of the over-crowding affect it would have on the schools. <br /> Robert W. Wentz, Jr., 4730 River Shore Road, spoke mn opposition of the proposed GHP-80- <br />2, requesting the application be denied. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Early, that the matter to be referred to the <br />meeting of July 8, 1980, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, questions raised by Mr. Wentz to be <br />referred to the Planning Commission and a report to be furnished prior to the meeting of <br />July 8, 1980, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> Motion of Mr. Gray and seconded by Mr. Early, to direct the City Attorney for a judicial <br />determination as to whet~erthe burrow pit fence requirements can be retroactively applied to <br />this location. <br /> <br /> Substitute motion of Mr. Early and seconded by Mr. Gray, that the City Attorney render <br />a legal opinion as~-~o~hether the burrow pit~!enc~ re. quiKe~enta can'be retroactively applied tot his <br />location, and was adopted by unanimous vote. ~ <br /> <br /> Motion of Mr. Holley and seconded by Mr. Beamer, that the motion to be amended for a <br />report to be furnished at the first meeting after'~July 1, 1980, and the motion was adopted <br />as amended, and by unanimous vote. <br /> <br />UNFINISHED BUSINESS - <br /> <br /> 80-169 The following ordinance approved on first reading at the regula~ meeting of <br />May 13, 1980, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $130,000 FROM THE CAPITAl IMPROVEMENT FUND FOR <br />EMERGENCY REPAIRS TO THE SEAWALL." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Gray, the ordinance was adoFted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Beamer, Gray~ Holley, Oast, Davis <br />Nays: None <br /> <br /> 80-170 The following ordinance approved on first reading at the regular meeting of <br />May 13, 1980, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $216,500 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />RENOVATION OF THE CITY JAIL." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Holley, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br />Mr. Early was absent from the Chamber on Items 80-169 ~ 80-170. <br /> <br /> <br />
