October 26, 1999 <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The marina shall be limited to 130 boat slips. <br /> <br />(b) Sixty-five parking spaces shall be provided. <br /> <br /> (c) The layout of the marina shall conform to the document titled <br />"Proposed Marina" and identified as Exhibit 1. Said Exhibit is attached hereto and <br />made a part hereof. <br /> <br /> (d) The marina shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br />(e) All taxes and fees shall be paid when due. <br /> <br /> REVOCATION OF PERMIT: Violation of any of the above conditions may serve <br />as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />99 - 238 - Adoption of an ordinance to amend Section 32-8 of the Code of the City of <br />Portsmouth to provide the City Manager broader authority regarding encroachments in <br />public rights-of-way. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Section 32-8 of the Code of the City of <br />Portsmouth to provide the City Manager authority to grant encroachments in public <br />rights-of-way. <br /> <br />Purpose and Need: <br /> <br />· The amendment will provide the same broad authority for the City to allow <br />encroachments as provided by the State Code. <br /> <br />· It will allow the City Manager to permit encroachments for new construction and to <br />authorize existing encroachments. <br /> <br />· It will impose requirements ensuring that encroachments will be granted only when <br />in the public interest. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact for this item. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, asked for additional information on the <br /> item. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND AND REORDAIN SECTION 32-8 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, DEALING WITH ENCROACHMENT PERMITS." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />99 - 239(a) - Adoption of a resolution authorizing the City Manager to enter into a lease <br />purchase agreement for property owned by Sweetbriar Development Corporation on <br />Crawford Street. <br /> <br /> (b) - Adoption of a resolution authorizing the City Manager to dedicate a parcel <br />of property for the widening of Crawford Street. <br /> <br /> <br />
