October 26, 1999 3. That this use permit is approved subject to the following conditions: (a) The marina shall be limited to 130 boat slips. (b) Sixty-five parking spaces shall be provided. (c) The layout of the marina shall conform to the document titled "Proposed Marina" and identified as Exhibit 1. Said Exhibit is attached hereto and made a part hereof. (d) The marina shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. (e) All taxes and fees shall be paid when due. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Recommendation: · Adoption of an ordinance to amend Section 32-8 of the Code of the City of Portsmouth to provide the City Manager authority to grant encroachments in public rights-of-way. Purpose and Need: · The amendment will provide the same broad authority for the City to allow encroachments as provided by the State Code. · It will allow the City Manager to permit encroachments for new construction and to authorize existing encroachments. · It will impose requirements ensuring that encroachments will be granted only when in the public interest. Financial Impact: · There is no financial impact for this item. 1. Mark Geduldig-Yatrofsky, 363 Middle Street, asked for additional information on the item. Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE TO AMEND AND REORDAIN SECTION 32-8 OF THE CODE OF THE CITY OF PORTSMOUTH, DEALING WITH ENCROACHMENT PERMITS." (b) - Adoption of a resolution authorizing the City Manager to dedicate a parcel of property for the widening of Crawford Street.
