<br />At a regular meeting of the City Council held on November 25, 1980, there were present:

<br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J. Robert Gray, Edward L.
<br />Oast, Jr.,Gloria O. Webb, Morton V. Whitlow, Rohert T. Williams, City Manager,
<br />Steven Lieberman, City Attorney.

<br /> Rev. Dale P. Wyatt, Pastor, Grove Park Baptist Church, opened the meeting with prayer,
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Motion of Mr. Oast and seconded by Mrs. Webb, minutes of the called meeting of November
<br />10, 1980; minutes of the regular meeting of November 10, 1980 to be approved as received and
<br />was adopted by unanimous vote. '
<br />UNFINISHED BUSINESS
<br />
<br /> 80-400 The following ordinance approved on first reading at the regular meeting of
<br />November 10, 1980, was taken up and read:
<br />
<br />"AN ORDINANCE TO APPROPRIATE ~9,075,000 FROM THE CAPITAl IMPROVEMENT FUND FOR
<br />STEP III OF THE PINNERS POINT SEWAGE TREATMENT PROJECT."
<br />
<br /> On motion of Mr. Gray and seconded by Mr. Beamer, the ordinance was adopted, and by the
<br />following vote:
<br />
<br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen
<br />Nays: None
<br />
<br /> 80-401 The following ordinance approved on first reading at the regular meeting of
<br />November 10, 1980, was taken up and read:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $50,000 FROM THE CAPITAL IMPROVEMENT FUND FOR 'HOT
<br />SPOT' DRAINAGE, CURB AND GUTTER PROJECTS."
<br />
<br /> On motion of Mrs. Webb and seconded by Mr. Barnes, the ordinance was adopted, and by
<br />the following vote:

<br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen
<br />Nays: None
<br />
<br /> 80-402 The following ordinance approved on first reading at the regular meeting of
<br />No~ember 10, 1980, was taken up and read:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $35,000 FROM THE CAPITAl IMPROVEMENT FUND FOR
<br />ADDITIONAL FUNDING REQUIRED FOR THE CONSTRUCTIONs'OF THE NEW ANIMAL SHELTER
<br />ON FREDERISK BOULEVARD."
<br />
<br />Motion of Mr. Gray and seconded by Mr. Barnes, the ordinance be adopted.
<br />
<br /> Motion of Mr. Beamer and seconded by Mr. Gray, the ordinance be amended to take effect
<br />subject to the execution o£ the contract, and was adopted by unanimous vote.
<br />
<br />On motion, the ordinance was adopted as amended, and by the following vote:
<br />

<br /> 80-404 The following ordinance deferred from the regular meetzng of November 10, 1980,
<br />was taken up and read:
<br />
<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY
<br />AMENDING SECTIONS 2-230 AND 2-231 THEREOF, PERTAINING TO THE PORTSMOUTH CABLE
<br />COMMISSION."

<br />The following report was submitted by the City Attorney:
<br />
<br /> "In 1974, the Portsmouth Cable Television Comaission was established to make a study of cable tele-
<br /> vision with regard to construction of such a system in the City of Portsmouth and to monitor
<br /> the constpuction and operation of the Cable Television Franchise. Construction of the system
<br />kis substantially complete and the Commission's role in the future will primarily be in monitor-
<br /> ing the operation of the franchise. The proposed amendments to §[2-230 and 2-231 of the City
<br /> Code pertaining to said Commission, restructures the membership of the Commission similar to
<br /> other City Commissions by removing the City Manager, City Attorney and the Superintendint of
<br /> the Schools as voting members. This amendment does not, however, change the responsibilities
<br /> and duties of the Commission and it will continue to function in order to monitor the Cable
<br /> Television Franchise. It should be noted that this Commission has exclusive original jurisdict
<br /> of all complaints made to the City concerning the Cable Television Franchise and has the
<br /> authority to conduct public hearings to inquire into the merits of any complaints or recommenda
<br /> made to it by subscribers, users or patrons of the franchise. Any party dissatisfied with
<br /> the Commission's disposition may thereafter present the matter directly to this Council.

<br /> At the present time, Cable construction within the City of Portsmouth has been substantially
<br />complete with the exception of the Olde Towne neighborhood which requires underground cable.
