<br /> 3. That for the purpose of funding such contract obligation, bonds of the City of
<br />Portsmouth are authorized to be issued to be known as General Obligation Bonds pursuant to
<br />the provisions of Chapter 5 of Title 15.1, Code of Virginia, 1950, as amended, and provisions
<br />of law applicable thereto. The said bonds shall be Serial Bonds and shall be issued at
<br />one time and shall be in such form and of such denomination as the Council shall direct.
<br />Each issue shall be payable not exceeding forty (40) years from its date, and said bonds
<br />shall bear interest at a rate or rates to be hereinafter determined by the Council upon
<br />the sale of said bonds; providing that the maximum rate of interest shall not exceed the
<br />maximum rate of interest autkorized by law at the time of the sale of said bonds.
<br />
<br /> 4. That sim~dtaneously~wiih~t!~ement o~i:said notes of the Authority, the payment
<br />of a portion which is hereby guaranteed, or provision having been made for the retirement
<br />of said notes, this resolution shall terminate and be of no effect.
<br />
<br /> 5. The provisions of this resolution shall become effective when the cities of
<br />Franklin, Norfolk, Suffolk and Virginia Beach have incurred contract obligations to provide
<br />payments to the Authority in the amounts of $36,000., $1,305,000,, $218,000. and $943,000.,
<br />respectively.

<br />6. That this resolution shall take effect from the date of its adoption."

<br /> 81-69 - "Consideration of a resolution endorsing the Utility Service Contract, refuse
<br />derived fuel service, Department of the Navy, Contract N62470-80-C-3916, between Norfolk
<br />Naval Shipyard, Portsmouth, Virginia, and, the Southeastern Public Service Authority of
<br />Virginia.
<br />
<br /> On January 28, 1981, the Board of Directors of the Southeastern Public Service Authority
<br />reached an agreement with the U. S. Navy on the proposed Solid Waste Disposal Facility.
<br />This agreement has been referred to the City of Portsmouth and other governing bodies parti-
<br />cipating in the project for approval. The City Manager recommends adoption." i!

<br /> On motion of Mr. Gray and seconded by Mr. Whitlow, the following resolution ~as adopted,
<br />andb~y the following vote:

<br />"A RESOLUTION ENDORSING THE UTILITY SERVICE CONTRACT, REFUSE DERIVED FUEL SERVICE,
<br />DEPARTMEN~ OF THE NAVY, CONTRACT N62470-80-C-3916, BETWEEN NORFOLK NAVAL SHIPYARD,
<br />PORTSMOUTH, VIRGINIA, AND THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA.
<br />
<br /> WHEREAS, on January 28, 1981, the Board of Directors of the Southeastern Public
<br />Service Authority of Virginia reached agreement with the U. S. Navy on the proposed Solid
<br />Waste Disposal and Resource Program for the purchase of refuse derived fuel to be generated
<br />hy a facility to be constructed in Portsmouth, Virginia; and
<br />
<br /> WHEREAS, the Board of Directors of the Southeastern Public Service Authority of
<br />Virginia.has submitted the propesed agreement to the seven (7) local governing bodies
<br />which are participating in the Solid Waste Disposal and Resource Recovery Program for
<br />review and approval; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, deems it to be in the best
<br />interest of City and its citizens to continue implementation of the Regional Solid Waste
<br />Disposal and Resource Recovery Program.
<br />
<br /> NOW, THEREFORE, Bg IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the Utility Service Contract, Refuse Derived Fuel Service, Department of the Navy,
<br />Contract N62470-80-C-39t6, between Norfolk Naval Shipyard, Portsmouth, Virginia, and the
<br />Southeastern Public Service Authority of Virginia, be hereby endorsed and approved,
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to
<br />notify the Board of Directors of Southeastern Public Service Authority of Virginia of
<br />action."

<br /> 81-70 - "Consideration of a motion authorizing the refund of $44.40 in personal property
<br />taxes collected in error.
<br />
<br /> This motion will authorize a refund of $44.40 to Timothy J. Lassiter for personal
<br />property taxes assessed on a 1979 Dodge automobile in error. The correct assessment should
<br />have been on a 1977 Dodge automobile and a partial refund is in order. The City Manager
<br />recommends adoption."

<br /> Motion of Mr. Beamer and seconded by Mr. Gray, that authorization be granted to refund
<br />$44.40 to Timothy J. ~assiter for personal property laxes, as requested, and was adopted by
<br />
