February 24, 1981 <br /> <br /> WHEREAS, said proposed legislation does not provide for the submission to the City of <br />Portsmouth of a site plan of the proposed development of said property for review an~ <br />approval by the governing body of the City in accordance with ~40-69(b) of the Zoning Code <br />of the City of Portsmouth and for the orderly development of p~operty within the boundaries <br />of the City of Portsmouth; and <br /> <br /> WHEREAS, said proposed legislation does not define that portion of the 623 acre tract <br />to be used for the coal exporting facility, thereby precluding any attempt by the City to <br />participate in the development of the remainder of the tract for industrial or port related <br />purposes; and <br /> <br /> WHEREAS, the City of Portsmouth is opposed to the taking by the Virginia Port Authority <br />of any portion of the subject property not actually and specifically required for the <br />location and construction of a coal exporting facility thereby reducing the value of the <br />remaining land for development purposes; and <br /> <br /> WHEREAS, other potential sites for a coal exporting facility exist in the Hampton <br />Roads area; and <br /> <br /> WHEREAS, the financial viability of the proposed <br />term necessity of the construction of additional coal <br />not been established. <br /> <br />development and the ultimate long <br />exporting capacity in Virginia has <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the City Manager and the City Attorney be, and they hereby are, authorized <br />to determine the appropriate action necessary to insure the development of the 623 acres <br />site owned by Trails End Land Company in a manner compatible with development requirements <br />by private enterprise and to the best interest of the City of Portsmouth and its residents; <br />to report such recommended action not later than March 10, 1981. <br /> <br /> 2. That the City Manager and the City Attorney be, and they hereby are, authorized <br />to consult immediately with the Governor of Virginia and the Virginia Port Authority in <br />regards to proposals of development of said property including, but not limited to, revenue <br />to be derived by the City of Portsmouth and the submission for review and approval by this <br />governing body of a site plan of the proposed development to include the p~an for rail access <br />and to define the actual property to be acquired by the Virginia Port Authority and to define <br />such other development criteria as would normally be required of a private developer by <br />the City Code. <br /> <br /> 3. That the Portsmouth delegation to the General Assembly of Virginia be, and they <br />hereby are, requested to offer amendments to the legislation~proposed~by the Governor of <br />Virginia in regards to development of said property as a coal exporting facility-'to provide: <br /> <br />full.~a~ <br />and tool <br /> <br />(a) That the City of Portsmouth receive as revenue from the Virginia Port Authority <br />equivalency including real property tax, personal property tax and/or machinery <br />tax as would be applicable if said development were privately owned and operated. <br /> <br /> (b) That the Virginia Port Authority be required to submit for approval by the <br />governing body of the City of Portsmouth a site plan of the proposed development designating <br />such aspects of the development as would be required on a similar site plan according.to <br />the requirements of the Code of the City of Portsmouth if the property were privately owned, <br />including in addition a plan for the orderly and satisfactory development of rail access <br />to the subject property in accordance with the traffic control requirements and environmental <br />quality of life of the City of Portsmouth. <br /> <br /> (c) That the Virginia Port Authority be limited in the amount of land, including <br />waterfront access, to be acquired to only that acreage which is specifically required for <br />the location and operation of the coal exporting facility having an annual capacity not to <br />exceed twenty million tons. <br /> <br /> (d) That the Governor of Virginia assure the General Assembly that all potential <br />sites for such facility in Hampton Roads and all possibilities for such facility to be <br />developed by private enterprise have been thoroughly investigated before a decision is <br />made to proceed with a public facility; that the Governor further assure the General <br />Assembly that the proposed development is financially viable and that the ultimate long <br />term requirement of construction of additional coal exporting capacity in Virginia is <br />necessary. <br /> <br /> 4.~ That the City Clerk be, and she hereby is, authorized to forward copies of this <br />resol~tion_~to the Governor of the Commonwealth of Virginia and to Senator Willard J. Moody, <br />Delegate L.
