December 14, 1999 <br /> <br /> (d) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia. <br /> <br /> 2. That a group housing use permit for a one-bedroom apartment unit at 707 <br />Dinwiddie Street is hereby granted to the applicant, Robert Craig, subject to the <br />following terms and conditions: <br /> <br /> (a) The applicant shall develop the site in accordance with the plans submitted at <br />the time of application. <br /> <br /> (b) All exterior changes to the building must be approved in advance by the <br />Downtown Design committee. <br /> <br /> (c) The applicant and any successor in interest shall comply with all applicable <br />statutes, ordinances and regulations of federal, state and local governments and shall <br />obtain and maintain in effect all required permits. <br /> <br /> (d) All taxes owed on or in connection with the subject property shall be paid <br />when due. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section 40- <br />115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />99 - 269 - Adoption of a special ordinance establishing January 3, 2000 as the date for <br />observing the New Year's Day 2000 legal holiday. <br /> <br />Recommendation: <br /> <br />· Adoption of a special ordinance establishing January 3, 2000 as the date for <br />observing the New Year's Day 2000 legal holiday. <br /> <br />Purpose and Need: <br /> <br />· This year, New Year's Day falls on a Saturday. Section 2-111 (b) of the City Code <br />states that whenever any of the City's legal holidays falls on a Saturday, it shall be <br />observed on the preceding Friday. <br /> <br />· The Commonwealth of Virginia, as well as many other localities in Hampton Roads <br />have chosen to move observance of the New Year's Day holiday from Friday, <br />December 31, 1999 to Monday, January 3, 2000 to allow for an extra work day before <br />the "Y2K" transition, should it be needed. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact as the maximum annual leave payout limit applies <br />should employees terminate before using leave carried over. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Benn, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"A SPECIAL ORDINANCE ESTABLISHING JANUARY 3, 2000, AS THE DATE FOR <br />OBSERVING THE NEW YEAR'S DAY 2000 LEGAL HOLIDAY." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
