September 8, 1981 <br /> <br />At a regular meeting of the City Conncil held on September 8, 1981, there were present: <br /> <br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J/ Robert Gray, Edward L. <br />Oast, Jr., Gloria O. Webb, Morton V. Whitlow, G. Robert House, Jr., City Manager, <br />Steven Lieberman, City Attorney. <br /> <br /> Rev. James H. Trader, Pastor, Park View Christian Church, opened the meeting <br />followed by the Pledge of Allegiance To the Flag. <br /> <br />Mayor Johansen welcomed all visitors in attendance. <br /> <br />with prayer, <br /> <br /> Motion of Mr. Beamer and seconded hy Mr. Gray, minutes of the called meeting of August <br />25, 1981; and minutes of the regular meeting of August 25, 1981, to be approved as received, <br />and was adopted by unanimous vote. <br /> <br />UNFINISHED BUSINESS - <br /> <br />81-306 <br /> <br />Use Permit UP 81-14 Resolution <br />and Industrial Commission and M. <br />facility on property located in <br />approved on first reading at the <br />presented. <br /> <br />granting a use permit to the PorTsmouth Port <br />Shawver Associates, Inc., to operate a coal <br />the Pinners Point araa north of Scotts Creek, <br />regular meeting of August 25, 1981, was <br /> <br />The following spoke for UP 81-14: <br /> <br />Johnny Cl%mons, 5805 Dunkirk Street, Chairman, Citizens Advisory Committee made-'the <br />following presentation: <br /> <br /> "I stand before you tonight as the Chairman of the Portsmouth Citizens Advisory Committee <br />I am here to express the conssnsus of the Committee concerning the preliminary approval of the <br />Shawver Associates Coal Terminal F~6!i~'ty-in Pinners Point. The Committee has eleven members, <br />nine of whom were present on August 31, 1981 and voted unanimously to endorse the approval of <br />the land use permit for the new coal loading facility. The City of Portsmouth is not mn a <br />position economically, to look a gifted horse mn the mouth. The City has but a few natural <br />resources to attract industry, and deep water is one of them. <br /> <br /> I submit to you that if the developers are willing; after we have placed 19 stringent <br />restrictions on development, still desire to build in Portsmouth then we support that action. <br />For this Citizens Advisory Committee has listened to and visited too many civzc groups ex- <br />pressing desires for better services within the City. We need the tax base and we need the <br /> <br />R. Charles Gentry, 2511 Dovenhill Court, Woodbridge, VA, representing Portsmouth Coal <br />Terminal, urged approval of the application and referred to the actions and commitments <br />to apply to the additional concerns expressed by Council at the meeting of August 25, 198 <br />S. DeLacy Stith, 3604 Cedar Lane, representing NAACP as former President and Member of <br />the Board, spoke in support of the use permit and urged Council to approve the applica- <br />tion. <br />George D. Eastes, 300 Park Road, representing Portsmouth Port & Industrial Commission, <br />spoke in support. <br />Charles Whitehurs, 6521 Bickford Lane, representing Portsmouth Chamber of Commerce, <br />urgedCouncil to support the use permit for the facility. <br /> <br />The following spoke in opposition of UP 81-14: <br /> <br />John Wallace, 300 Deal Drive, stated that those who spoke for the application were <br />from out-or-town and telling Council what i~ best for the community this he did not <br />approve. <br />Bill Crandell, 4441 Birch Road, representing Sea-Land, Inc. spoke ~n opposition to the <br />terms of the conditional use permit, referring to areas in question. <br />M. P. Hessek, 5300 W. Norfolk Road, representing Tidewater Guild for Infant Survival, Inc <br />& Sweethaven NeighborhoOd Club, spoke against an industry that would pollute the environ- <br />ment and inconvenient to t he'citizens and suggested that the C~ty look into industry that <br />would enhance the community. <br />Lewis Thomas, 131 Florida Avenue, representing Port Norfolk Civic League, stated that <br />the citizens of Port Norfolk were against the coal facility. Recently, representatives <br />from Port Norfolk had visited Coal Loading Terminal at Morehead City, N. C. and referred <br />to the report submitted. (Exhibit 81-306) <br /> <br />Motion of Mr. Barnes and seconded by Mrs. Webb, to adopt the resolution granting UP 81-14 <br /> <br /> Motion Qf Mr. Whitlow and <br />executive session to discuss a <br />unanimous vote. <br /> <br />seconded by Mr. Beamer, to table the matter to go into an <br />legal matter relative to the use permit, and was adopted by <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Whitlow, that the matter regarding the use permi <br />be brought back from the table for consideration, and was adopted by unanmmous vote. <br /> <br /> Moti~ of Mr. Barnes and seconded by Mr. Beamer, that the resolution be amended to refle¢ <br />the concerns'raised by citizens and City Council, and was adopted by unanimous vote. <br /> <br /> On motion the following resolution was adopted as amended, and by the following vote: <br /> <br /> <br />
