January 11, 2000 <br /> <br />00 - 07 - Adoption of a resolution authorizing the City Attorney to acquire by eminent <br />domain proceedings a parcel of property at Virginia Avenue and Woodrow Street which <br />is needed for the improvement of Virginia Avenue. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Attorney to acquire by eminent domain <br />proceedings a parcel of property at the corner of Virginia Avenue and Woodrow Street <br />needed for the improvement of Virginia Avenue. <br /> <br />Purpose and Need: <br /> <br />· This area of 134 square feet is needed to improve the radius at this corner. <br /> <br />Financial Impact: <br /> <br />· The appraised value of the property is $700. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, TO <br />ACQUIRE BY EMINENT DOMAIN PROCEEDINGS PROPERTY OWNED BY <br />NATHANIEL L. THOMAS, SAID PROPERTY BEING NECESSARY TO IMPROVE <br />VIRGINIA AVENUE. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia has determined that it <br />is in the public interest, and a public necessity, to improve Virginia Avenue from High <br />Street to Cleveland Street; and <br /> <br /> WHEREAS, the City has made a bona fide but thus far ineffectual effort to <br />acquire the property described herein; and <br /> <br /> WHEREAS, the advancement of the work and use of the property cannot <br />proceed until it has been acquired, and the use of the property will be unreasonably <br />delayed if the property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />That the City Attorney be, and he hereby is, directed to institute eminent domain <br />proceeding, or cause such proceedings to be instituted against the hereinafter <br />described property situate in the City of Portsmouth, Virginia, for the purpose of <br />acquiring fee simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 of the Charter <br />of the City of Portsmouth, as amended, said property being designated and shown as <br />Proposed RAN Area = 134 Sq. Ft. or 0.0031 Acres on that certain plat entitled:" Plat <br />Showing Property To Be Acquired By City Of Portsmouth for Right Of Way Purposes, <br />Portsmouth, Virginia", dated April 28, 1999, prepared by Horton & Dodd, P.C. <br /> <br />The name of the property owner is Nathaniel L. Thomas. <br /> <br /> The property has been appraised for $700.00, and such sum as the Court shall <br />order as compensation shall be paid according to order of said Court." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />00 - 08 - Adoption of a resolution to support the study and development of a regional <br />bikeway to serve the cities of South Hampton Roads. <br /> <br />Several South Hampton Roads cities are exploring the feasibility of creating a <br />continuous paved bikeway from downtown Suffolk to Old Dominion and Norfolk <br />State Universities. <br /> <br /> <br />
