<br />At a regular meeting of the City Council held on March 9, 1982, there were present:

<br />J. E. Johansen, Jack P. Barnes, Ben A. Beamer, Sr., J. Robert Gray, Edward L.
<br />Oast, Jr., Gloria O. Webb, G. Robert House, Jr., City Manager, Steven Lieberman,
<br />City Attorney.

<br /> Rabbi Judah L. Fish, Temple Gomley Chesed, opened the meeting with prayer, followed
<br />the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Johansen welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Beamer and seconded by Mr. Gray, minutes of the called meeting of February
<br />23, 1982; minutes of the regular meeting of Bebruary 23, 1982; minutes of the called meeting
<br />of March 3, 1982, to be approved as received, and was adopted by unanimous vote.

<br />Public Hearing on ordinance to amend Chapter 40 of the Code, pertaining to
<br />Amusement Enterprises in the Commercial C-2 District and Commercial Recreation
<br />Centers was held.
<br />
<br />No one spoke.
<br />
<br /> Motion of Mrs. Webb and seconded by Mr. Gray, to amend Chapter 40, by amending Sections
<br />40-31, 40-45, 40-71(b) and by adding a new Section 40-67.2, as amended in accordance with the
<br />City Attorney's recommendation on the number o~f machines permitted in Commercial Recreation
<br />Centers.
<br />
<br /> 82-53 Substitute motion of Mr. Barnes and seconded by Mr. Beamer, that 82-53 be
<br />adopted to replace 82-78.
<br />
<br /> Motion of Mr. Oast and seconded by Mr. Beamer, to amend the substitute motion, by
<br />changing "and" to "or" in Section 3-35(c), third word, line 5, was adopted by 4-2(Gray,Webb)
<br />vote.
<br />
<br /> On motion of the substiture motion, as amended, the following ordinance was adopted,
<br />and by the following vote:
<br />
<br />"AN ORDINANCE rO AMEND ARTICLE III OF CHAPTER 3 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO COMMERCIAL RECREATION CENTERS."
<br />

<br /> Upon the advice of the City Attorney, no action was taken on 81-435(c)UP 81-20~ 82-50(f)
<br />UP 82-3, (h)UP .82-6, in that Council's adoption of 82-53 rendered such applications "moot,,.~
<br />
<br /> 82-50(j) - An ordinance to amend the code of the City of Portsmouth, Virginia, 1973,
<br />amended, by amending Sections 40-71(a) and (b), pertaining to uses mn the Commercial C-2
<br />District, deferred from the Public Hearing of February 8, 1982, was presented.

<br /> On motion of Mr. Barnes and seconded by Mr. Beamer, the ordinance was approved on first
<br />reading, and was adopted by 4-2(Gray, Webb) vote.
<br />
<br />The following reports from the City Manager were presented:
<br />
<br /> 82-80 "Consideration of a resolution authorizing the issuance of $3,217,964 of General
<br />Obligation Bonds of the City of Portsmouth, Virginia, for the purpose of providing funds to pa
<br />for various capital improvements, extensions and additions to the water and sewer systems of
<br />the City.
<br />
<br /> This.'r~solution, together with the resolutions approved July 14, 1981, in the amount
<br />of $5,281,814 and January 13, 1981, in the amount of $10,754,837, brings the total bond
<br />authorization to date to $19,254,615. This resolution provides funding for Public Utility
<br />projects that are recommended for funding at this time. The City Manager recommends adop-
<br />tion.''

<br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE ISSUANCE OF $3,217,964 OF GENERAL OBLIGATION
<br />BONDS OF THE CITY OF PORTSMOUTH, VIRGINIA, FOR THE PURPOSE OF PROVIDING
<br />FUNDS TO PAY THE COST OF CERTAIN CAPITAL IMPROVEMENTS, EXTENSIONS AND ADDI-
<br />TIONS TO THE WATER AND SEWER SYSTEM OF tHE CITY AND AUTHORIZING AND PROVIDING
<br />WITH RESPECT TO THE ISSUANCE AND SALE OF A LIKE PRINCIPAL AMOUNT OF GENERAL
<br />OBLIGATION BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE AND RECEIPT
<br />OF THE PROCEEDS OF SALE OF SUCH BONDS.
<br />
<br /> WHEREAS, it is necessary for the City of Portsmcuth, Virginia (the "City") to provide
<br /> funds for various capital improvements, extensions and additions to the water and sewer
<br />zYygtem of the City as hereinafter set forth; and
