264 <br /> <br />March 22, 1983 <br /> <br /> 83-107 = <br />Section 24-100 Of the City Code by adding Subsection (c) <br />Park Golf Course an'd Portsmouth Sleepy Hole Golf Course. <br /> "It has been brought to my attention that there is <br />Code to allow for the reduction or waiver of green fees <br />promotional activities. <br /> <br />Letter from the City Manager recommending the adoption of an ordinance to amend <br /> pertaining to golf course::!:-fees at Cit <br /> <br />no provision in the Portsmouth City <br />at Portsmouth's Golf Courses for <br /> <br /> I can envision that because of the City's golf courses and their growing popularity, <br />that we can attract visitors to our City and thereby generate additional tax dollars from our <br />hotels and restaurants. By developing entertainment packages for these special activities the <br />City can increase its market share of the reginnal tourism trade. I might note that I have <br />asked all city departments to encourage their professional associations, whether national, <br />state or regional to consider holding their annual meetings in Portsmouth. <br /> Therefore, I recommend that the attached ordinance be adopted to allow for the waiver or <br /> reduction of green fees for special occasions and activities." <br /> On motion of Mrs. Webb and seconded by Mr. G~ay, the following ordinance was adopted on <br /> first and finals reading, and by the following vote: <br /> "AN ORDINANCE TO AMEND SECTION 24-100 OF THE CODE OF THE CITY OF PORTSMOUTH, <br /> VIRGINIA, 1973, BY ADDING THERETO SUBSECTION (c) PERTAINING TO GOLF COURSE <br /> FEES AT CITY PARK GOLF COURSE AND PORTSMOUTH SLEEPY HOLE GOLF COURSE." <br /> Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br /> Nays: None <br /> <br /> 83-111 - Letter from the City Manager recommending adoption of a motion to refund cost <br /> for City Decal purchased in error. <br /> "The Commissioner of Revenue has requested a refund for a City motor vehicle decal for <br /> Bernie R. O'Connor, 2108 Leckie Street, Portsmouth, VA 23704. <br /> The automobile was sold in January 1983, therefore, a refund in the amount of $20 with- <br /> out ~ntc~est is requested." <br /> Motion of Mr. Barnes and sc~onde~ by Mr. Gray, that authorization be granted to refund to <br /> Bernie R. O'Connor $20.00, without interest, for City motor vehicle decal, and was adopted by <br /> unanimous vote. <br /> 85-112 - Letter from the City Manager recommending adoption of a motion authorixing the <br />City Manager to enter into a contract with the Southeastern Public Service Authority. <br /> "The City o~f Portsmouth's incinerator is in violation of the emission standards set forth <br /> in the State's Regulations for the Control and Abatement of Air Pollution, since it discharges <br /> particulate matter in excess of that permitted. The incinerator is twenty years old and modi- <br /> fication to meet the emiss'ion standards would be cost prohibitive. As such, a request for <br /> variance to'tKe emission standards was sent to the State Air Pollution Control Board's Regiona] <br /> Office on November 17, 1982 and a public hearing on the matter was held on February 25, 1983. <br /> Our request for a variance was limited to the timeiit would take for SPSA to get the regional <br /> landfill operational in Suffolk, presently estimated to be January 1, 1985. There was no <br /> publico opposition to our request for a variance and the regional personnel of the State Air <br /> POllution Control Board have indicated they w-~ll submit a favorable recommendation on our <br /> request to the State Board. However, they were concerned that there was, as yet, no formal <br /> declaration on the part of the City of its intent to join the regional landfill once it be- <br /> came operational. I advised them that the matter would be brought before Council for its con- <br /> sideration. They were pleased to learn this since the fina~l hearing on the matter will be <br /> held in April at the state level. I will have City representation~at the final hearing. <br /> Attached is an agreement between SPSA and the City of Portsmouth which commits us to futu <br /> use of the ~egio~al landfill. By participating in the regional landfill we would plan to close <br /> our ~ncinerator and landfill operations. Using SPSA's best estimates it is projected that the <br /> City will realize a $150,000 reduction in its refuse disposal costs. By joining the Reginal <br /> Landfill the Citx would be losing its administrative control over refuse disposal. The City <br /> would also commit itself to future cost increases in the operation of the regional landfill. <br /> This point is especially important as it ~elates to the possibility of future EPA regulations <br /> and associated costs necessary to come into compliance. <br /> The unacceptable expense associated with meeting EPA air pollution requirements necessi- <br /> tates that I recommend closing of the City aperated incinerator and landfill and joining the <br /> SPSA regional landfill. Therefore, I reluctantly recommend that you approve the agreement <br /> as proposed." <br /> Motion of Mr. Barnes and seconded by Mr. Beamer, that the Eity Manager be authorized to <br /> enter into a.~cogtraet:~with~Ihe Southeastern Public Service Authority, as requested, and was <br /> adopted by unanimous vote. <br /> 83-113 Letter from the City Manager+=recommending the adoption of a motion to abate and <br /> refund $2,205.93 in Real Estate Taxes erroneously assessed. <br /> "Attached is a lette¥.~from the City Assessor requesting the abatement and refund of <br /> $2,205.93 plus interest in Real Estate Taxes to Lomas <br /> which were assessed and paid in error for the 1st, <br /> <br /> I recommend adoption of this motion to abate <br />assessed." <br /> <br />e <br /> <br /> & Nettleton Company for James R.
