Beamer, Sr., James W. Holley, III, Gloria O. Webb, Morton V. Whitlow, <br /> George L. Hanbury, City Manager, Steven Lieberman, City Attorney. <br /> <br /> Absent: Jack P. Barnes, J. Robert Gray, J. E. Johansen <br /> Vice Mayor Beamer presided in the absence of Mayor Johansen. <br /> The following call for the meeting was read: <br /> <br /> 83~Et- "Please attend a call meeting of the Portsmouth City Council to be held on Frida <br />April 1, 1983, at 11:00 a.m. Conference Room, 6th Floor, City Hall, for the purpose of con- <br />sidering a motion to go into Executive Session to discuss legal matters including contracts <br />and litigation. In addition, the Council may meet in Public Session to discuss the impositio; <br />of Federal copyright fee by Cox Cable Television on citizens of Portsmouth. <br /> <br />By order of the Vice Mayor." <br /> <br /> Mormon of Mr. Whitlow and sezonded by Mrs. Webb, to go into an executive session for the <br />purpose of discussing legal matters including contracts and litigation, was adopted by unani- <br />mous vote. <br /> <br /> City Council reconvened at 11:35 a.m. in a public session. <br /> <br /> 83-~B2- On motion of Mr. Whitlow and seccnded by Mrs. Webb, <br />adopted, and by the following vote: <br /> <br />the following resolution was <br /> <br /> "A R~SOLUTION EXPRESSING THE CONCERN OF THE COUNCIL OF THE CITY OF PORTSMOUTH <br /> RELATIVE TO ACTIONS TAKEN BY COX CABLE OF PORTSMOUTH. <br /> <br /> WHEREAS, effective March 1S, 1983, the Copy{{ght Royalty {ribunal increased the Copyright <br />Royalty Fees by nine (9) percent; and <br /> <br /> WHEREAS, Cox Cable of Portsmouth, Inc. has announced that, as a result of such action and <br />pursuant to its study of the law, research of the potential effects and survey of its subscrib <br />it will impose an eighty-one ($0.81) cent Copyright Royalty Fee per basic subscriber per month <br />in order to comply with the Copyright Royalty Fee mandate; and <br /> <br /> WHEREAS, the imposition of this fee was commenced without consideration by the City Coun, <br />and <br /> <br /> WHEREAS, <br />Beach as well <br />as well; and <br /> <br />Cox Cable provides a unitary system serving the cities of Norfolk and Virginia <br />as Portsmouth and has imposed the additional fee on the citizens of those citie~ <br /> <br /> WHEREAS, the Council of the City of Portsmouth is concerned about the imposition of the <br />fee on the citizen subscribers and the validity of Cox's action in imposing such fee without <br />the concurrence of City Council. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the Ci{y of Portsmouth directs the <br />City Manager and the City Attorney and a representative of the Cable Television Commission to <br />meet with officials of Cox Cable of Portsmouth, Inc.~ <br /> <br /> BE IT FURTHER RESOLVED that this Council request Cox Cable of Portsmouth, Cox Cable of <br />Virginia Beach and Cox Cable of Norfolk to ~all a meeting of appropriate officials of each of <br />the affected communities to discuss this issue on a regional basis. <br /> <br /> BE IT FURTHER RESOLVED that this Council request Cox Cable of Portsmouth, Inc. to defer <br />collection of the Copyright Royalty Fee until this matter is resolved." <br /> <br />Ayes: Beamer, Holley, Webb, Whitlow <br />Nays: None <br /> <br />On motion meeting adjourned. <br /> <br /> Vi~ %~yor ! ~ <br /> <br />~rs, <br /> <br />11; <br /> <br /> <br />
