<br />followed by the Pledge of Allcgiance~to the Flag.

<br /> Mayor Johansen welcomed all visitors in attendance.

<br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, minutes of the called meeting of Septembe-
<br />13, 1983; minutes of the regular meeting of September 13, 1983, to be approved as received
<br />and was adopted by unanimous ~ote. '

<br />83-356 - Allen Peterson, President of Norfolk Bowling Association, presented/Mayor Johanse
<br />the Mayor's Trophy for Annual Mayor's Bowling Tournament, as being the Champion of Tidewater
<br />Bowling Week. Gene Luke was present, and also, was the Mayor's partner for the Tournament.

<br /> (a) On motion of Mrs. Webb and seconded by Mr. Beamer, the following resolution was
<br />adopted on final reading, and by the fellowing vo-te:
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO OLIVE C. BROWN, PASTOR FOR FAITH DELIVERANCE
<br />CENTER FOR A CHURCH AND PLACE OF WORSHIF AT 608 EFFINGHAM STREET.
<br />
<br /> WHEREAS, Clive C. Brown, pastor for Faith Deliverance Center, has made application
<br />pursuant to ~40-71 of the Code o£ the City of Portsmouth, Virginia, 1973, for the granting
<br />of a use permit as hereinafteY-de.seribed; and
<br />
<br /> WHEREAS, the applicant and the ~lann~ng Director have done all things required to be
<br />done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, .Virginia:
<br />
<br /> 1. That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) Will not as a temporary use for a period not to exceed eighteen (18) months
<br />adversely affect the health and safety of persons residing or working in the neighborhood
<br />of the proposed use;
<br />
<br /> (b) Will not as a temporary use for a period not to exceed eighteen (18) months
<br />be detrimental to the publi£ n~e or injur-ious to the property or improvements of the
<br />neighborhood; and
<br />
<br /> (c) Will as a temporary use for a period not to exceed eighteen (18) months be
<br />in accordance with the purpose, s of the Zoning Chapter of the City Code.
<br />
<br /> 2. Olive C. Brown, pastor of Faith Deliverance Center, is hereby granted a use
<br />permit pursuant to ~0-71~b) of the Code of the City of Portsmouth, Virginia to operate a
<br />church and house of worship at 608 Effingham Street which is more particularly described
<br />as Tax Map 49, Parcel 29 (UP-83-3).
<br />
<br /> 3. This use permit is approved subject to the following conditions:
<br />
<br /> (~] That the applicant will comply with all codes, ordinances and regulations of
<br />Commercial C-2 Zoning District requirements relating to the operation of a church and
<br />Kouse of worship.
<br />
<br /> ~) The building shall meet the apprc~al of the Building, Fire and Health Department~
<br />for a place of assembly, and shall be limited to seventy-five (75) people at any one time;
<br />provided, however, that if the necessary improvements are made thereto, Fire and Building
<br />Officials may approve expansion of the capacity to three hundred (300) people provided all
<br />code requirements for such capacity including, but not limited to, parking requirements
<br />are met.

<br />required by ~40-45 of the City Code, and that the use of remote parking lots must meet
<br />requirements of §40-47 of sa~d..qqd.e.' .......
