Portsmouth Boulevard between Turnpike Road and 1-264 - 9,690 vehicles daily. <br /> <br />4.' Elm Avenue between~ South Street an~d Race Street - 8,340 vehicles daily, <br /> <br />5. Churchland Boulevard between High Street West and Tyre Neck Road 13,320 <br /> vehicles daily. <br /> <br /> It is unfortunate that I have ~to give this recommendation, however, I feel that a year'is <br />sufficient time to have had some positive action from this Railroad Company. It is, therefore <br />recommended, and I concur, that we adopt the attached resolution authorizing that the Seaboard <br />Coast Line Railroad Company be notified pursuant to Section 56-405, Code of Virginia and take <br />such further action as may be necessary to repair the same. <br /> <br /> In addition, should the Seaboard Coast Line Railroad Company not respond as required by <br />law, I am making a further recommendation to appropriate $228,000 for repair of these crossing! <br />Reimbursement of this amount will be sought from the Seaboard Coast Line Railroad Company." <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Whitlow, the following resolution was adopted <br />and by the following vote: <br /> <br />"A RESOLUTION DESIGNATING CERTAIN RAILROAD CROSSINGS AS BEING POORLY MAINTAINED <br />BY THE SEABOARD COAST LINE RAILROAD COMPANY; AUTHORIZING THE CITY MANAGER TO <br />NOTIFY SEABOARD COAST LINE RAILROAD COMPANY PURSUANT TO SECTION 56-405, CODE'OF <br />VERGINIA¥ AND TO TAKE SUCH FURTHER ACTION AS MAY BE NECESSARY TO REPAIR THE SAME. <br /> <br /> WHEREAS, the.Seaboard Coast Line Railroad Company operates certain hereinafter-described <br />railroad crossings over public streets in the City of Portsmouth; and <br /> <br /> WHEREAS, said railroad company is re:quired by law to keep such~ crossings in good repair tc <br />the full width of the public street and to maintain such crossings in a smoothe condition so al <br />to admit reasonable and safe travel over the same; and <br /> <br /> WHEREAS, the hereinafterrdescribed crossings have not been maintained in such good repair <br />and condition. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the following described railroad crossings are designated as being poorly maintained by Seaboa <br />Coast Line Railroad Company. <br /> <br />(1) <br /> <br />(3) <br /> <br />Frederick Boulevard between Incinerator Road and Project Drive; <br /> <br />Victory Boulevard between Airline Boulevard and Alexander <br />Portsmouth Boulevard between Turnpike Road and 1-264; <br /> <br />Street; <br /> <br />(4) Elm Avenue between South Street and Race Street; <br /> <br />(S) Churchland Boulevard between High Street West and Tyre Neck Road. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to notify <br />Seaboard Coast Line Railroad Company of the condition of said crossings pursuant to ~56-405, <br />Code of Virginia, and to take such further action pursuant to said section of the Code of <br />Virginia as may be necessary to repair the same" <br /> <br />Ayes: Barnes Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />83-414 - Ordinance to appropriate $220,000 for Railroad Crossing repairs. <br /> <br /> Motion of Mr. Barnes and seconded by Mrs. Webb, to defer the matter to the next meeting <br />(November 22, 1983) until~Co~nci%oh~s g~opportunity to discuss the legal ramifications and <br />procedure to take if the issue is approved, and was adopted by unanimous vote. <br /> <br /> 8S-415 - Letter from the City Manager recommending adoption of a resolution authorizing <br />the issuance of $1,824,876 in General Obligation Bonds and Bond Anticdpation Notes in, order <br />to fund the first year of the 1983-84 Capital Improvement Progzam. <br /> <br /> "On October 24, 1983, City Council held a Public Hearing concerning the Capital Improve- <br />ment Program. The attached resolution authorizes the issuance of $1,824,876 in General <br />Obligation Bonds and Bond A~ticipation No,~es in order to fund the first year of the 1983-84 <br />CIP, <br /> <br /> The 1983-84 CIP includes projects requiring bond fnnding in the total amount of $5,997,25( <br />however, due to bond funds currently available (from the November 1982 bond sale) only a net <br />amount of new bond authorization.totaling $1,824,876 is required. The Municipal Finance Com- <br />mission has reviewed and endorsed the 1984 CIP funding level ~ith particular attention directe{ <br />towards the amount requiring bond financing. A copy of this letter has been distributed to <br />the City Council in a pre~ious package. <br /> <br /> I recommend the adop~i6n of this resolution so that the 1st year of the S year can be <br />fully funded." <br /> <br /> <br />
