Februar~ 22, 2000 <br /> <br /> (c) Is compatible with and will not adversely affect or be materially <br />detrimental to adjacent uses, residents, buildings, structures, or natural resources; <br /> <br /> (d) Will be provided with sufficient landscaping to insure compatibility <br />with surrounding uses; <br /> <br /> (e) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (f) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Roger Brown is hereby granted a use permit pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the operation of an <br />entertainment establishment to be located at 316 High Street, being more particularly <br />described as: <br /> <br />UP-00-04 <br /> <br />Beginning at a point 185'+ east of the the northeast corner of the <br />intersection of Court Street and High Street; thence, east 67'+ to a <br />point; thence, north 57'+ to a point; thence, east 2'+ to a point; <br />thence, north 82'+ to a point; thence, west 3'+ to a point; thence, <br />north 87'+ to a point; thence, west 70'+ to a point; thence, south <br />112'+ to a point; thence, east 4'+ to a point; thence, south 114'+ to <br />the point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The hours of operation shall be between 10:30 A.M. to 2:00 A.M. <br /> <br /> (b) The site shall be developed in accordance with plans submitted to <br />and approved by the Building Official's Office. <br /> <br /> (c) The applicant shall operate the entertainment establishment in <br />accordance with all applicable codes, ordinances and regulations of federal, state and <br />local governments, and shall obtain and maintain in effect all necessary licenses and <br />permits. <br /> <br /> (d) All activities conducted on the subject property shall comply with <br />the City of Portsmouth Noise Ordinance, as established in Section 24-255 of the City <br />Code. <br /> <br /> (e) All exterior modifications shall be subject to approval by the <br />Downtown Design Committee. <br /> <br />9P.M. <br /> <br />(f) <br /> <br />Ingress/egress shall not be permitted from Queen Street after <br /> <br /> (g) All taxes owed on the subject property or in connection with the <br />proposed operation shall be paid when due. <br /> <br />(h) The use permit shall not be transferable. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve <br />as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
