Februar~ 22, 2000 (c) Is compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources; (d) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (e) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (f) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Roger Brown is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of an entertainment establishment to be located at 316 High Street, being more particularly described as: UP-00-04 Beginning at a point 185'+ east of the the northeast corner of the intersection of Court Street and High Street; thence, east 67'+ to a point; thence, north 57'+ to a point; thence, east 2'+ to a point; thence, north 82'+ to a point; thence, west 3'+ to a point; thence, north 87'+ to a point; thence, west 70'+ to a point; thence, south 112'+ to a point; thence, east 4'+ to a point; thence, south 114'+ to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) The hours of operation shall be between 10:30 A.M. to 2:00 A.M. (b) The site shall be developed in accordance with plans submitted to and approved by the Building Official's Office. (c) The applicant shall operate the entertainment establishment in accordance with all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses and permits. (d) All activities conducted on the subject property shall comply with the City of Portsmouth Noise Ordinance, as established in Section 24-255 of the City Code. (e) All exterior modifications shall be subject to approval by the Downtown Design Committee. 9P.M. (f) Ingress/egress shall not be permitted from Queen Street after (g) All taxes owed on the subject property or in connection with the proposed operation shall be paid when due. (h) The use permit shall not be transferable. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
