Beamer, Sr., E. G. Corprew, Jr., J. Robert Gray, <br />L. Louise Lucas, Gloria O. Webb, Morton V. Whitlow, George L. Hanbury, City <br />Manager, Steven Lieberman, City Attorney. <br /> <br /> Rev. Percy O. White, Pastor of St. Marks Baptist Church, opened the meeting with prayer, <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Beamer and seconded by Mrs. Webb, minutes of the called meeting of Februar <br />26, 1985; minutes of the regular meeting of February 26, 1985; and minutes of the called <br />meeting of March 5, 1985, to be approved as received, and was adopted by unanimous vote. <br /> <br />85-70 Public Hearing on rezoning, use permit, and group housing applications: <br /> <br />(a) Zoning Petition Z 85-6 <br /> <br />Rezoning application of W. F. Magann Corp., Owner, for <br />property located at 3805 Adams Street; from Residential <br />R-1S0 to Industrial M-2. <br /> <br /> Eddy G. Harwell, 3219 Channel Avenue, representing W. F. Magann Corporation, was present <br />to answer questions. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, to concur in the <br />Planning Commission, to rezone property located at 3805 Adams Street <br />to Industrial M-2, and the following ordinance was approved on first <br />vote: <br /> <br />recommendation of the <br />from Residential R-150 <br />reading by unanimous <br /> <br />'ZONING AMENDMENT ORDINANCE Z 85-6" <br /> <br />(b) Zoning Petition Z 85-7 <br /> <br />Rezoning application of Associated Churchland Investors, <br />Owners, by Ripley Wright Associates Ltd., for a parcel <br />of land on the east side of Twin Pines Road lying between <br />the subdivision of Twin Pines and the Seaboard Coast Line <br />Railroad; from Industrial M-1-R to Residential R-75-K <br />Conditional and R-100-K Conditional. <br /> <br /> Ronald Ripley, 1515 N. Military Highway, Norfolk, representing Ripley Wright Associates, <br />spoke in support of the application. <br /> <br /> Joseph Preziotti, Jr., 421- Quince Road, representing applicant, presented site plan f6r <br />the rezoning. <br /> <br /> Robert F. Ripley, 1515 N. Military <br />and John P. Wright, 2417 Lakewood Lane, <br />were present. <br /> <br />Highway, Norfolk, representing Ripley Wright Associate <br />Chesapeake, representing RipleyWriyht Associates, <br /> <br />The following c~tizens spoke in opposition of the rezoning: <br /> <br />Thomas W. Thacker, 3936 Merrifields BoulevarJ, representing Merrifields Civic League. <br />Motion of Mrs. Webb and seconded by Mr. Beamer, that Mr. Thacker be granted an additional <br />5 minutes to speak, and was adopted by unanimous vote. <br />Motion of Mrs. Webb, seconded by Mr. Gray, to grant Mr. Baule an additional 2 minutes, was adopted by <br />Fred Baule, 4100 Tarnywood Drive, representing Merrifields Civic League, presented the <br />following petition: <br /> <br /> "We, the undersigned residents anJ homeowners of Portsmouth, netition the Portsmouth <br />City Council to withh61d approval of the requested rezoning of t~e 92 acre Twin Pines <br />site as currently proposed. Our two maior concerns requiring corrective action prior <br />to Council approval are: <br /> <br /> 1.A significant reduction in the number of dwelling units proposed <br /> particularly the 360 apartments. <br /> 2. That Greenbrook Drive should not be a through road connecting Twin Pines <br /> Ro~d and Cedar Lane. <br /> <br /> Ou~ CiVic League would have opposed this issue at the Planning Commission public hearing, <br />however we were award through press reports that the City Planning Department would oppose thi <br />rezoning. We incorrectly believed the Planning Commission would follow staff recommendations <br />not relinguish the light industrial~commercial zoning, known as Southampton Center, that the <br />city and developer worked so hard for back in 1977. As some of you may recall, the two civic <br />groups most affected by that rezoning, the Twin Pines concerned citizens and the Merrifields <br />Civic League, worked together with the developer and the City to address all concerns. This <br />was a successful city~developer/commnnity effort resulting ~n support for Southampton Center. <br />Mr. Nathan Thomas, from Twin Pines, expressed his group's snrong support for Southampton <br />Center and I presented for Merrifields a statement of conditional support based on the City <br />ag$~f~ us the "Declaration of Restrictions" agreed to by the developer would in fact be <br />documenteJ and enforced. As you know, this was accomplished through use of a new conditional <br />zoning approach. <br /> <br /> We further mistakenly believed the Planning Commission would reject this proposal in <br />it is in conflict with the Comprehensive Plan.
