<br /> (d) On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was
<br />adopted on final reading, and by the following vote:

<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1993, AS AMENDED, SAID
<br />PROJECT BEING LOCATED ON 18 WATERFRONT ACRES IN THE BEAZLEY FARM AND DESIGNATED
<br />AS GHP-S5-15."

<br /> WHEREAS, Henry J. Williams, Harkins Associates, Inc. for E.S.G. Enterprises, Inc., have
<br />made application pursuant to Section 40-55 of the Code of the City of Portsmouth, Virginia,
<br />1973, as amended, for the granting and approval of a Group Housing Project consisting of two
<br />hundred fifty (250) dwelling unizs organized into three (3) four 14) story buildings of two
<br />hundred '200) units and five (5) cottage courts containing fifty (S)) units on eighteen (18)
<br />waterfront acres in the Beazley Farm and designated as GHP-S5-15; and
<br />
<br /> WHEREAS,
<br />requirements

<br />
<br />the application has been determined by the
<br />of Section 40-55 of the Ccde of the City of
<br />
<br />Planning Commission to have met the
<br />Portsmouth, Virginia, 1973, as amende
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application site plan submitted there-
<br />with, and_has recommended a conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuanl
<br />to Section 40-55 grants only an exemption from certain requirements for residences as stated
<br />in said section, and does not constitute a waiver of any other requirement embodied in the sub~
<br />division ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other
<br />applicable local, state or federal law or regulations: and
<br />
<br /> WHEREAS, the developer is aware that building p~rmits or any other required permit will
<br />be issued only upon compliance with the ordinance, laws, or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE I7 RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project designated as GHP-S5-15, more specifically described in
<br />correspondence from the applicant received by the Director of Planning and shown on plans
<br />entitled "River Point Life Care" which have been filed withe appropriate officials of the City
<br />of Portsmouth, Virginia, such correspondence and plans being made a part hereof, is hereby
<br />granted approval subject to the following terms and conditions:
<br />
<br /> i. Occupancy of the project will not be permitted until utilities and streets are
<br />extended to the site.
<br />
<br /> 2. Prior to issuance of building permits, a landscaping plan addressing ~e.gtm~of
<br />court areas and buildings must be submitted the Planning Office for review and approval.
<br />
<br /> 3. A standard site improvement plan must be submitted to the Department of Engineering
<br />and Technical Services for review and approval.
<br />
<br /> 4. The prem~oss shall not be used other than for housing for persons and/or heads of
<br />households sixty-two (62) years and older unless and until compliance With any parking require
<br />ments applying to the new use have been made."

<br />'AN ORDINANCE TO ~¥iEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA,
<br />1973, BY AMENDING SECTION 40-17 THEREOF AND ADDING THERETO SECTIONS 40-85 AND
<br />40-141 PERTAINING TO THE PLANNED OFFICE PARK DISTRICT AND PURPOSE AND DIMENSION
<br />REQUIREMENTS THEREOF."

<br />"AN ORDINANCE TO APPROPRIATE FUNDS NECESSARY FOR OPERATION OF THE CITY
<br />GOVERNMENT FOR AND DURING THE FISCAL YEAR BEGINNING JULY 1, 1985 AND ENDING
<br />JUNE 30, 1986."
<br />
<br /> Jane L. Majer, 339 Park Manor Road, representing Endependence Center, Inc., asked for
<br />consideration of full funding for the Center, as requested.
<br />
<br />Motion of Mr. Whitlow and seconded by Mr, Beamer, to adopt the ordinance.
<br />
<br /> Motion of Mr. Beamer and seconded by Mr..Whitlow to amend the ordinance and grant
<br />$2,400 to the Endependence Center, and was adopted by unanimous vote.
