<br />At a Regular Meeting of the City Council on Tuesday, December 9, 2025, there
<br />were present:
<br />
<br />Mayor Shannon E. Glover, Vice Mayor William E. Moody, Jr., Mark A. Hugel, Vernon L.
<br />Tillage, Jr., Kathryn W. Bryant, Dr. William S. Dodson, Jr., Yolanda E. Thomas, City
<br />Manager Steven Carter, Interim City Attorney Derek G. Challenger.

<br />Mayor Glover asked for a moment of silence, which was followed by the Pledge of
<br />Allegiance to the Flag.
<br />
<br /> Mayor Glover called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Hugel, to adopt the minutes of a Called
<br />Meeting of November 24, 2025, of a Called Meeting of November 25, 2025, and of a
<br />Regular Meeting of November 25, 2025, was adopted by the following vote:

<br />Ayes: Bryant, Dodson, Hugel, Moody, Thomas, Tillage, Glover

<br />25 - 331 - Public hearing on code amendment and use permit applications:

<br />GEORGE WASHINTON HIGHWAY
<br />25-359 - Adoption of a resolution
<br />revoking the use permit (UP-25-03) issued to R. Brown to operate an
<br />Entertainment Establishment on a portion of 2012 Victory Boulevard
<br />designated as 4806 George Washington Highway, in accordance
<br />with Section 40.2-533(L) of the City of Portsmouth Zoning
<br />Ordinance. The Use Permit was originally approved by City Council
<br />on August 26, 2025 through Resolution R-25-24. The reason for
<br />considering revocation of the Use Permit is the failure of the
<br />establishment to comply with one or more conditions of approval.
<br />The entertainment establishment is commonly known as Bar 9. The
<br />property is owned by Washington/Victory, LLC.
<br />
<br />1. Renata Brown, 3517 Radford Circle, Chesapeake, spoke in opposition to this item.
<br />
<br />2. Tim Anderson, 2492 North Landing Road, Virginia Beach, spoke in opposition to this
<br /> item.

<br />Motion by Mr. Hugel, and seconded by Mr. Moody, to adopt the following
<br />resolution, and was adopted by the following vote:
<br />
<br />“RESOLUTION REVOKING USE PERMIT UP-25-03 FOR THE OPERATION OF AN
<br />ENTERTAINMENT ESTABLISHMENT ON A PORTION OF A PARCEL HAVING AN
<br />ADDRESS OF 2012 VICTORY BOULEVARD (TAX PARCEL 0456-0010).
<br />
<br /> WHEREAS,
<br />by Resolution R-25-24 adopted on August 26, 2025, the City Council
<br />of the City of Portsmouth, Virginia granted a conditional Use Permit (UP-25-03) to R.
<br />Brown to operate an entertainment establishment on a portion of a parcel having an
<br />address of 2012 Victory Boulevard (Tax Parcel 0456-0010) (the said portion having a
<br />mailing address of 4806 George Washington Highway); and
<br />
<br />WHEREAS,
<br /> Section 40.2-533(L)(2) of the Zoning Ordinance provides as follows:
<br />
<br />(L) Revocation. A Use Permit may be revoked by City Council after conducting
<br />a public hearing. The permit shall be revoked only if Council finds:
