October 28, 2025 <br /> <br />WHEREAS, <br /> on September 23, 2025 the City issued a preliminary acceptance of <br />the proposal for the purposes of publication and conceptual-phase consideration; and <br /> <br />WHEREAS, <br /> in accordance with the City’s PPEA Guidelines, the City subsequently <br />issued public notice of the receipt of the unsolicited proposal and an invitation to submit <br />competing proposals; and <br /> <br />WHEREAS, <br /> once all proposals have been received, the PPEA Guidelines require <br />that the City perform an analysis regarding the specifics, advantages and disadvantages, <br />and long and short-term costs of the proposals; and <br /> <br />WHEREAS, <br /> the analysis may be performed solely by qualified third-party <br />professionals not employed by the City or, if approved by City Council, by employees of <br />the City; and <br /> <br />WHEREAS, <br /> given that the subject matter of the unsolicited proposal and any <br />additional proposals received will be the type of facilities which City staff currently <br />operates and with which staff is intimately familiar, it is proposed that the analysis should <br />be performed by employees of the City with the assistance of qualified third-party <br />professionals; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED <br />by the Council of the City of Portsmouth, <br />Virginia that, in accordance with the City’s PPEA Guidelines and § 56-575.3:1(C)(1) of <br />the Virginia Code, it hereby determines that employees of the City should perform the <br />required analysis, with such assistance from qualified third-party professionals not <br /> <br />employed by the City as determined appropriate by the City Manager.” <br /> <br />25 - 317 - Adoption of a resolution approving and authorizing the City Manager to <br />execute and deliver a First Amendment to Agreement for Use and Support of a <br />Solid Waste Disposal System with the Southeastern Public Service Authority. <br /> <br />Background: <br /> <br />The Southeastern Public Service Authority (“SPSA”) is a political subdivision <br /> <br />created by statute to address regional solid waste disposal and consisting of member <br />localities Portsmouth, Chesapeake, Franklin, Norfolk, Suffolk, Virginia Beach, Isle of <br />Wight and Southampton. <br /> <br /> <br /> By Resolution R-17-07 adopted on January 24, 2017, City Council authorized the <br />City Manager to execute an Agreement for Use and Support of a Solid Waste Disposal <br />System with SPSA (the “Existing Agreement”). <br /> <br /> The Existing Agreement has a conditional expiration date of June 30, 2027. <br /> <br /> The proposed amendment to the Existing Agreement would (1) make a minor <br />modification to the definition of “Recyclable Waste” to accord with existing practice and <br />(2) conditionally extend the term of the Agreement through June 30, 2052. <br /> <br />Discussion: <br /> <br />The regional landfill only has the solid waste disposal capacity to last <br /> <br />approximately thirty-five years; therefore, it is necessary to find alternate means to <br />dispose of waste. <br /> <br /> <br /> SPSA has recently undertaken a procurement process and selected a contractor <br />to enter into a contract for the acceptance and processing, recycling, recovery, reuse <br />and/or disposal of 100% of the waste delivered by or on behalf of SPSA to the contractor’s <br />permitted facilities. <br /> <br />The contractor will invest approximately $200 million to provide a mixed waste <br /> <br />sorting facility that would guarantee a landfill diversion rate of 50%. <br /> <br /> <br />However, the contractor cannot be expected to make this investment without <br /> <br />commitments from SPSA’s member localities to remain part of SPSA for at least twenty <br />years following completion of the facility. <br /> <br /> <br />Therefore, SPSA has requested that the member localities authorize the execution <br /> <br />of the First Amendment to the Existing Agreement. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
