September 9, 2025 <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to construct a freestanding telecommunications <br />tower at 0 West Norfolk Road, the said property being more particularly described as: <br /> <br />UP-25-07 <br /> <br />0 West Norfolk Road <br />(Tax Parcel 0723-0012) <br /> <br />BEGINNING at a point on the eastern right-of-way line of Old Coast Guard Boulevard at <br />its intersection with property now or formerly Commonwealth Railway, Incorporated (Tax <br />ID # 10000180); thence running along the eastern right-of-way line of Old Coast Guard <br />Boulevard, a 60 foot wide public right-of-way, N 06°53’57”W a distance of 129.37 feet to <br />a point; thence turning and leaving said eastern right-of-way line of Old Coat Guard <br />Boulevard and running S 65°03’17” E a distance of 465.44 feet to a point, said point being <br />on said line of property now or formerly Commonwealth Railway Incorporated; thence <br />turning and running N 80°31’17”W a distance of 412.11 feet to a point, said point being <br />the point of beginning. <br /> <br />IT BEING that certain property conveyed to 4740 Cell Tower, LLC by Deed from Suffolk <br />Mechanical, LLC dated May 5, 2025 and recorded in the Clerk’s Office of the Circuit Court <br />for the City of Portsmouth, Virginia as Instrument Number 202504680. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the overall site plan and <br />tower elevation depicted in the preliminary site plan entitled “VAC026 ORLEANS” <br />prepared by WT GROUP and submitted to the Planning Department on June 27, 2025, <br />except where modifications may be required to comply with all applicable local, state, and <br />federal codes and regulations. <br /> <br />(b) The height of the monopole telecommunications tower shall not exceed 195 feet, <br />measured as the vertical distance from the average grade adjacent to the tower to the <br />highest point of the tower (including antennas). <br /> <br />(c) Without limitation, the development shall ensure and maintain compliance with the <br />following use-specific standards in accordance with Zoning Ordinance Sec. 40.2- <br />217(E)(3)(b). <br /> <br />(i) No zoning permit for any radio, television, or microwave towers shall be issued <br />until the applicant provides evidence that the Federal Aviation Administration (FAA) has <br />granted a permit for said tower or that no permit is required. <br /> <br />(ii) The applicant shall provide a copy of the Federal Aviation Administration (FAA) <br />report and documentation that the application presents no hazard to any airport, or <br />documentation that FAA review is not required. <br /> <br />(iii) Space shall be provided for at least three (3) cellular or similar providers, unless <br />expressly approved for less as a condition of the Use Permit. <br /> <br />(iv) The applicant shall provide a listing of all structures within one-half (0.5) mile that <br />are of a similar elevation along with an explanation of why a colocation on another tower <br />is not possible, to the extent permitted by law. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
