September 9, 2025 <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the site plan concept <br />entitled “Victory Crossing Apartments – Site Plan” prepared by Retnauer Baynes <br />Associates dated June 26, 2025, except where modifications may be required to comply <br />with all applicable local, state, and federal codes and regulations. This condition is not <br />intended to preclude additional landscaping beyond that shown in the aforesaid site plan <br />concept, so long as the additional landscaping does not violate any applicable code or <br />regulation. <br /> <br />(b) The development shall be in substantial compliance with the rendered concept <br />elevations entitled “Victory Crossing Apartments – Exterior Elevations” prepared by <br />Retnauer Baynes Associates submitted July 27, 2025, except where modifications may <br />be required to comply with all applicable local, state, and federal codes and regulations. <br /> <br /> <br />(c) Prior to initially operating the multifamily dwelling development and so long as the <br />use remains in operation, the owners and/or operators shall install and maintain digital <br />video equipment with recording capabilities sufficient to indicate the date and the time <br />that the recording is made. The recording shall provide surveillance coverage <br />encompassing the front, side, and rear exteriors of the development for 24 hours a day, <br />7 days a week. Recorded data must be maintained in a condition permitting review of the <br />information for no less than 30 days. <br /> <br />(d) Before approval of the site plan, the owner or operator must provide written <br />documentation confirming approval of the proposed use by Lowe’s Home Centers, Inc., <br />as required by certain use restrictions documented in the Amended and Restated <br />Operation and Easement Agreement between Portsmouth Redevelopment and Housing <br />Authority and Lowe’s dated May 4, 2001, as subsequently amended. <br /> <br />(e) The development shall be constructed in compliance with applicable codes, <br />ordinances, and regulations of federal, state, and local government, and all required <br />licenses and permits shall be obtained and remain in effect during the operation of the <br />development. <br /> <br />(f) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City Treasurer. <br /> <br />(g) This Use Permit shall automatically expire and become void two (2) years from the <br />date of approval by City Council if the use is inactive or changed to a different use, unless <br />within such two-year period: (i) A building permit is obtained, and erection or alteration of <br />a structure is started; or (ii) a Certificate of Occupancy is obtained and the approved use <br />is commenced. <br /> <br />(h) All buildings, structures, and landscape areas on the property shall be adequately <br />maintained in accordance with the standards required by the City Zoning Ordinance, the <br />City Code, and the Virginia Property Maintenance Code. <br /> <br />REVOCATION OF PERMIT: <br />7.
