<br />ALL THAT certain lot, piece or parcel of land, situate in the City of Portsmouth, Virginia,
<br />(formerly in the Borough of Western Branch, City of Chesapeake, State of Virginia), and
<br />bounded and described, according to a plat which was duly recorded with a certain deed
<br />from John S. Morris, et ux, to Robert A Levin, et ux, dated February 2, 1966 and duly
<br />recorded in the Clerk’s Office of the Circuit Court of the City of Chesapeake, Virginia, in
<br />Deed Book 1454, at page 692 (see Map Book 46, at page 70), as follows:
<br />
<br />BEGINNING at a point on the south side of U.S. Route 17-A (Churchland By-Pass) at the
<br />intersection of said Route 17-A and what was the midline of what was formerly Academy
<br />Avenue and running thence south along the mid-line of Academy Avenue to the center
<br />line of a certain marsh; the property line of the Churchland Land Company, thence
<br />westerly and northwesterly along the property line of the Churchland Land Company in
<br />the center line of the marsh to a point on the southeast side of the right-of-way of the
<br />property now or formerly belonging to Atlantic and Danville Railroad; thence northeasterly
<br />along the right-of-way line of the Atlantic and Danville Railroad to a point of its intersection
<br />with the south side of U.S. Route 17-A thence southeasterly along the southern side of
<br />U.S. Route 17-A , 120 feet, more or less, to a point marked by a stone; thence continuing
<br />along the south side of Route 17-A on a curve to the left, having a radius of 1,954 feet
<br />and an arc distance of 217.63 hundreds feet, more or less to the point of beginning,
<br />together with that portion of Academy Avenue, title to which vested in the parties of the
<br />first part upon closing said Academy Avenue by action of the City Council of Chesapeake,
<br />Virginia, on August 9, 1966; and further described on that certain plat entitled “Subdivision
<br />of Property Owned by Houpas Enterprises, Inc., Portsmouth, Virginia” dated September
<br />29, 1981, revised November 9, 1981, and February 24, 1982, made by Ernest C.
<br />Hawkins, Jr. and Associates, Surveyors and Planners, Suffolk, Virginia, and duly
<br />recorded in the Clerk’s Office of the City of Portsmouth, Virginia, in Map Book 11, at page
<br />131.

<br />LESS, SAVE AND EXCEPT:
<br />
<br />PARCEL 1: THAT certain lot, piece or parcel of land which was conveyed by Houpas
<br />Enterprises, Inc. to Maury Wise Cook by deed dated April 16, 1982, and recorded in the
<br />Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia, in Deed Book 829,
<br />at page 337. And more particularly described therein as Lot 1, together with an easement
<br />as therein described.

<br />PARCEL 2: THAT certain lot, piece or parcel of land which was conveyed by Houpas
<br />Enterprises, Inc. to Elliot Cohen by deed dated March 29, 1982, and recorded in the
<br />Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia in Deed Book 826, at
<br />page 685, and more particularly described therein as Lot 2 together with an easement as
<br />therein described.

<br />PARCEL 3: THAT certain parcel of land having an address of 6063 High Street West and
<br />a City Tax Parcel number of 0816-0012.
<br />
<br />IT BEING a portion of Parcel Two of that certain property conveyed to City Line, LLC by
<br />Deed of Gift from Elliot Cohen dated July 20, 2010 and recorded in the Clerk’s Office of
<br />the Circuit Court for the City of Portsmouth, Virginia as Instrument Number 100007029.
<br />
<br /> 6. That the use permit is approved subject to the following conditions which
<br />shall be observed by the applicant and any successor in interest:
<br />
<br />(c) The owner and the operator of event space/banquet hall shall ensure and maintain
<br />compliance with the following use-specific standards, including as set forth in subsection
<br />40.2-217(G)(5)(c) of the Zoning Ordinance:
<br />
<br />(vi) The event space/banquet hall shall not create unreasonable environmental
<br />aspects such as noise, odor, smoke, vibration, heat, or glare.
<br />
<br />(vii) Noise from the event space/banquet hall shall comply with City Code Sec. 24-255
<br />Unlawful Excessive Sound.
