July 9, 2024 <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to operate an event space/banquet hall at 465 <br />Dinwiddie Street (Tax Parcel 0012-1030), the said property being more particularly <br />described as: <br /> <br />UP-24-05 <br /> <br />465 Dinwiddie Street <br />(Tax Parcel 0012-1030) <br /> <br />ALL THAT certain parcel of land lying, situate and being in the City of Portsmouth, <br />Virginia, and more particularly described on that certain plat entitled “Physical Survey of <br />#465 Dinwiddie Street, (REF. D.B. 292, Pg. 218), Portsmouth, Virginia, for G. Bill Backus <br />& S. Talmadge Carey”, dated January 5, 1988 and made by Ernest C. Hawkins, Jr. and <br />Associates, Surveyors and Planners, Suffolk, Virginia, which plat is duly recorded in the <br />Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia, in Deed Book 1000 <br />at page 1814, to which plat reference is hereby made for a more particular description of <br />said property; said property fronting 33.17 feet on Dinwiddie Street and having a depth of <br />73.6 feet. <br /> <br />IT BEING the same property conveyed to K & O Acquisitions LLC by Deed from Patricia <br />Bucher Woodward, a/k/a Patricia B. Woodward dated March 27, 2024 and recorded in <br />the Portsmouth Circuit Court Clerk’s Office as Instrument Number 202403044. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Without limitation, the establishment shall be maintained and operated in <br />compliance with the following standards: <br /> <br /> (i) The use shall not create unreasonable environmental aspects such as <br />noise, odor, smoke, vibration, heat, or glare. <br /> (ii) Noise from the establishment shall comply with City Code Section 24-255 <br />Unlawful Excessive Sound. <br /> (iii) Any building housing live entertainment shall include soundproof entryway <br />and exit doors. <br /> <br />(b) Prior to initially operating the approved use and so long as the use remains in <br />operation, the owners and/or operators shall install and maintain digital video equipment <br />with recording capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the front, side, <br />and rear exteriors of the establishment for 24 hours a day, 7 days a week. Recorded data <br />must be maintained in a condition permitting review of the information for a period of no <br />less than thirty days. <br /> <br />(c) Where required by the Zoning Ordinance, all external site and building <br />improvements, including signage, must be approved through issuance of a Certificate of <br />Appropriateness by the Downtown Design Committee prior to the commencement of <br />work. <br /> <br />(d) Prior to initially operating the event space/banquet hall, a Zoning Permit from the <br />Zoning Administrator and a Certificate of Occupancy from the Department of Permits and <br />Inspections must be obtained. <br /> <br />(e) All construction on the subject property must be conducted in compliance with all <br />applicable local, state, and federal codes, ordinances, and regulations. All required <br />licenses and permits must be obtained prior to commencement of any construction work <br />and maintained as required until completion of the work. <br /> <br />(f) The approved use must be operated in compliance with maximum occupancy load <br />limits, including patrons and staff, established by the building official. <br /> <br /> <br /> <br /> <br /> <br />
