October 24, 2023 <br /> <br />At a Regular Meeting of the City Council on Tuesday, October 24, 2023, there were <br />present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. <br />Mark M. Whitaker, De’Andre A. Barnes, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City <br />Manager Mimi C. Terry, City Attorney Lavonda Graham-Williams. <br /> <br />Mayor Glover asked for a moment of silence which was followed by the Pledge of <br />Allegiance to the Flag. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Moody, to adopt the minutes of <br />a Called Meeting of October 10, 2023, of a Regular Meeting of October 10, 2023, and of <br />a Closed Meeting of October 12, 2023, was adopted by the following vote: <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />23 - 318 - Use permit: <br /> <br />(d) UP-23-18 VICTORY CROSSING SHOPPING CENTER - Resolution granting <br />the request of George Williams for a Use Permit to operate an <br />entertainment establishment on the approximately 9.48-acre parcel <br />located at 4010 Victory Boulevard in Suite 4012 C of the Victory <br />Crossing Shopping Center in the General Mixed-Use (GMU) <br />zoning district. The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property for <br />commercial type land uses. The property is owned by Victory <br />Crossing Marketplace LLC (Christopher Lee). Planning <br />Commission recommends approval with conditions. Deferred from <br />the October 10, 2023, City Council meeting. <br /> <br />1. George Williams, 4446 Old Woodland Drive, Chesapeake, presented the application. <br /> <br /> Councilman Moody asked that staff revisit some of the conditions in the use permit <br /> <br />specifically excess vibration and glare. <br /> <br /> Councilman Whitaker asked that staff report back at an upcoming Public Work <br /> <br />Session. <br /> <br />Motion by Mr. Barnes, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-23-18) TO GEORGE WILLIAMS TO <br />OPERATE AN ENTERTAINMENT ESTABLISHMENT IN SUITE 4012C AT 4010 <br />VICTORY BOULEVARD (TAX PARCEL 0526-0022). <br /> <br /> <br />WHEREAS <br /> , George Williams (the agent for the contract lessee of the subject <br />property), has made application pursuant to Section 40.2-533 of the Code of the City of <br />Portsmouth, Virginia for the granting of a use permit to operate an entertainment <br />establishment in Suite 4012C at 4010 Victory Boulevard (Tax Parcel 0526-0022); and <br /> <br />WHEREAS, <br /> Victory Crossing Marketplace, LLC, the owner of the subject property, <br />has consented to the filing of the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br /> <br /> <br /> <br /> <br /> <br />
