September 12, 2023 (j) In accordance with Zoning Ordinance Sec. 40.2-533(L), this Use Permit may be revoked by City Council after conducting a public hearing. The permit may be revoked if Council finds: (i) The Use Permit was obtained or extended by fraud or deception; (ii) The applicant has failed to comply with one or more of the conditions of approval; (iii) There is a change in conditions affecting the public health, safety, and welfare, since adoption of the Use Permit; or (iv) There are repeated violations of the Zoning Ordinance by the holder of the Use Permit, related to the development approved by the Use Permit. REVOCATION OF PERMIT: 7. Violation of any of the conditions set forth herein may serve as grounds for revocation of the use permit by City Council.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None - City Manager’s Report - 23 - 280 - Adoption of an ordinance confirming the FY 2024 Classification and Pay Plan for employees of the City of Portsmouth, Virginia. Background:  The City’s annual Classification and Pay Plan establishes certain policies, procedures, and salary schedules for City of Portsmouth employees.  By Ordinance 2023-38 adopted during the budget process on May 9, 2023, City Council authorized the Interim City Manager to develop, administer, implement, and amend the FY 2024 Classification and Pay Plan for all classes of City of Portsmouth employees.  The Interim City Manager promulgated the FY 2024 Classification and Pay Plan on May 12, 2023 and the Plan is posted on the City website. Discussion:  The purpose of this ordinance is to confirm for the record the duly adopted FY 2024 Classification and Pay Plan (as it may be amended by the City Manager from time to time) and to incorporate and make the said Plan a part of Ordinance 2023-38. Financial Impact:  N/A Recommended Action:  Adoption of the ordinance. Next Steps Following Council Action:  The City Manager will continue to implement the Classification and Pay Plan. 1. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with salary caps. He also voiced his concern with no provision for collective bargaining. Motion by Ms. Lucas-Burke, and seconded by Mr. Barnes, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE CONFIRMING THE FY 2024 CLASSIFICATION AND PAY PLAN FOR EMPLOYEES OF THE CITY OF PORTSMOUTH, VIRGINIA.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None
