September 12, 2023 <br /> <br />(j) In accordance with Zoning Ordinance Sec. 40.2-533(L), this Use Permit may be <br />revoked by City Council after conducting a public hearing. The permit may be revoked if <br />Council finds: <br /> <br />(i) The Use Permit was obtained or extended by fraud or deception; <br />(ii) The applicant has failed to comply with one or more of the conditions of approval; <br />(iii) There is a change in conditions affecting the public health, safety, and welfare, <br />since adoption of the Use Permit; or <br />(iv) There are repeated violations of the Zoning Ordinance by the holder of the Use <br />Permit, related to the development approved by the Use Permit. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />23 - 280 - Adoption of an ordinance confirming the FY 2024 Classification and Pay <br />Plan for employees of the City of Portsmouth, Virginia. <br /> <br />Background: <br /> <br /> The City’s annual Classification and Pay Plan establishes certain policies, <br />procedures, and salary schedules for City of Portsmouth employees. <br /> <br /> By Ordinance 2023-38 adopted during the budget process on May 9, 2023, City <br />Council authorized the Interim City Manager to develop, administer, implement, and <br />amend the FY 2024 Classification and Pay Plan for all classes of City of Portsmouth <br />employees. <br /> <br /> The Interim City Manager promulgated the FY 2024 Classification and Pay Plan <br />on May 12, 2023 and the Plan is posted on the City website. <br /> <br />Discussion: <br /> <br /> The purpose of this ordinance is to confirm for the record the duly adopted FY 2024 <br />Classification and Pay Plan (as it may be amended by the City Manager from time to time) <br />and to incorporate and make the said Plan a part of Ordinance 2023-38. <br /> <br />Financial Impact: <br /> <br /> <br /> N/A <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will continue to implement the Classification and Pay Plan. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with salary caps. He <br />also voiced his concern with no provision for collective bargaining. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Barnes, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE CONFIRMING THE FY 2024 CLASSIFICATION AND PAY PLAN FOR <br />EMPLOYEES OF THE CITY OF PORTSMOUTH, VIRGINIA.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
