September 12, 2023 <br /> <br />At a Regular Meeting of the City Council on Tuesday, September 12, 2023, there <br />were present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. <br />Mark M. Whitaker, De’Andre A. Barnes, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City <br />Manager Mimi C. Terry, City Attorney Lavonda Graham-Williams. <br /> <br />Mayor Glover asked for a moment of silence which was followed by the Pledge of <br />Allegiance to the Flag. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Hugel, to adopt the minutes of a Called <br />Meeting of August 8, 2023, and of a Regular Meeting of August 8, 2023, and was adopted <br />by the following vote: <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- Presentation - <br /> <br /> <br /> Presentation of a proclamation for “Daffodil Project Day”. <br /> <br /> <br /> Armia Flythe, winner of the Police Department Youth Essay Contest, read her <br />award-winning essay. <br /> <br />- Public Hearings - <br /> <br /> <br />23 - 278Public hearing with respect to the proposed adoption by the City <br />Council of a resolution to request the General Assembly to amend <br />the present City Charter. The purpose of the proposed amendments <br />is to conform certain provisions of the Charter to the Virginia Code, <br />including (1) conforming the deadline for the filing of petitions for <br />candidacy for Mayor or City Council, acceptances of such candidacy, <br />and the names and addresses of campaign treasurers, to the <br />deadline provided in Section 24.2-507 of the Virginia Code; (2) <br />correcting an obsolete citation in the Charter to a Virginia Code <br />chapter that has been repealed; and (3) conforming the timeframe <br />for City Council to make an appointment to fill a vacancy on Council <br />to the timeframe provided in Section 24.2-228 of the Virginia Code. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in opposition to amending the <br /> charter by resolution. <br /> <br />23 - 279 - Public hearing on a use permit application: <br /> <br />UP-23-15 DOWNTOWN - Resolution granting the request of Thyme on the <br />River LLC for a Use Permit to operate an entertainment <br />establishment on approximately 0.619-acre parcel located at 1 High <br />Street Suite 4 in the Downtown D1 T6 Urban Core zoning sub- <br />district. The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property for mixed-use <br />downtown. The property is owned by One High Street LLC. Planning <br />Commission recommends approval. <br /> <br />1. Gabbi McClay, 1 High Street, presented the application. <br /> <br />2. Donna Biggs, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />3.
