July 11, 2023 <br /> <br />(j) The owners and/or operators of the establishment shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by patrons or customers. If the Chief of Police, in their <br />discretion, determines that there are violations of this type so as to comprise a significant <br />law enforcement issue, they may notify the applicant in writing and provide a copy of such <br />notice to the Zoning Administrator, which may result in the initiation of proceedings for the <br />revocation of this Use Permit. This clause is not to be construed as a limitation or waiver <br />of any other grounds for revocation of this Use Permit under the Zoning Ordinance or the <br />terms hereof. <br /> <br />REVOCATION OF PERMIT: <br />7. The applicant is <br />concurrently requesting a Use Permit for the self-service storage <br />facility use (UP-23-11). The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property for <br />Mixed-Use Employment. The property is owned by the Portsmouth <br />Redevelopment and Housing Authority (PRHA). Planning <br />Commission recommends approval. <br /> <br />1. Don Scott, 355 Crawford Street, presented the application. <br /> <br />2. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ZONING AMENDMENT ORDINANCE Z-23-04.” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Glover <br />Nays: Barnes, Whitaker <br /> <br /> <br />(c) UP-23-11 DOWNTOWN - Resolution granting the request of Don Scott, Esq., <br />on behalf of SAFStor Real Estate Co., LLC, for a Use Permit for a <br />three-story, 103,350 square-foot self-service storage facility with 793 <br />units on the approximately 5.38 acre property at 0 Effingham Street. <br />The property is currently zoned Downtown (D1) in the T5 sub-district. <br />The applicant is concurrently requesting a Rezoning of the property <br />to Conditional General Mixed-Use (GMU-K) zoning district (Z-23-04). <br />The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property for Mixed-Use <br />Employment. The property is owned by the Portsmouth <br />Redevelopment and Housing Authority (PRHA). Planning <br />Commissions recommends approval with conditions. <br /> <br />1.
