June 13, 2023 <br /> <br />(c) All operations shall be conducted wholly within an enclosed building and shall not <br />create a noticeable amount of noise, dust, odor, smoke, glare, or vibration outside of the <br />building in which the activity takes place. <br /> <br />(d) All operations involving manufacturing, assembly, fabrication, packaging, or other <br />industrial processing of products primarily from extracted or raw materials, the bulk <br />storage and handling of such products and materials, and any industrial operation having <br />potential to produce noise, dust, glare, odors, or vibration beyond the lot line of the subject <br />property are PROHIBITED. <br /> <br />(e) No loading areas, unloading areas, or trash receptacles shall be located within fifty <br />(50) feet of any residentially zoned property. <br /> <br />(f) Vegetative buffers complying with all requirements for a Type D landscape buffer <br />under Section 40.2-304(E) of the Zoning Ordinance shall be installed and maintained <br />adjacent to all adjoining residentially zoned property. <br /> <br />(g) Vegetation complying with all requirements of Section 40.2-304 of the Zoning <br />Ordinance and providing a fully opaque screen to the minimum height necessary to fully <br />screen all outdoor storage areas from the public right-of-way shall be installed and <br />maintained. The nature and design of the vegetation must be reviewed and approved by <br />the Zoning Administrator prior to Site Plan review approval for the development. <br /> <br />(h) Prior to initially operating the development and for so long as the approved use <br />continues on the subject property, the owners and/or operators shall install and maintain <br />digital video equipment with recording capabilities sufficient to indicate the date and time <br />that the recording is made. The recording shall provide surveillance coverage <br />encompassing the front, side, and rear exteriors of the development for 24 hours a day, <br />7 days a week. Recorded data must be maintained in a condition permitting review of the <br />information for a period of no less than thirty days. <br /> <br />(i) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and remain in effect during the operation of the <br />development. <br /> <br />(j) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />(k) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br />REVOCATION OF PERMIT: <br />7. The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property for Multi- <br />Family Residential. The property is owned by Sheppard Quality <br />Homes Inc.
