June 13, 2023 <br /> <br />(e) Prior to Site Plan Review approval, a Minor Subdivision plat creating a separate <br />parcel for each townhouse and complying with all applicable requirements of Chapter <br />33.1 of the City Code (Subdivisions) must have been approved by the City and recorded <br />in the land records. <br /> <br />(f) Prior to construction of the use, a site plan must be reviewed and approved by the <br />City. The site plan must comply with all applicable local, state, and federal codes and <br />regulations, including without limitation Chapter 31.2 of the City Code (Stormwater <br />Management). <br /> <br />(g) No trash cans shall be stored in the front or side yards of the townhouses. <br /> <br />(h) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to construction and remain in effect during <br />the operation of the development. <br /> <br />(i) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />(j) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br />(k) Shrubbery or opaque fencing shall be installed to buffer the development from the <br />railroad property located to the west. <br /> <br />REVOCATION OF PERMIT: <br />7. Barry, P.E., of AES Consulting Engineers, for a Use <br />Permit for a warehouse and light manufacturing use in order to <br />develop five (5) buildings totaling 61,200 square feet on <br />approximately 7.34 acres of land located at 1050 University <br />Boulevard in the Conditional General Mixed-Use (GMU-K) zoning <br />district. The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property as Commercial. The <br />property is owned by Terry-Peterson Residential company. <br />Planning Commission recommends approval with conditions. <br /> <br />1. Larry Barry, 816 Greenbriar Circle, Chesapeake, presented the application. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Barnes, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-23-08) TO AES CONSULTING <br />ENGINEERS FOR A WAREHOUSE AND LIGHT MANUFACTURING USE AT 1050 <br />UNIVERSITY BOULEVARD (TAX PARCEL 0833-0017). <br /> <br /> <br />WHEREAS <br /> , AES Consulting Engineers, on behalf of Terry/Peterson Investment <br />Thirty, L.L.C. and Terry/Peterson Residential Thirty, L.L.C., the owners of the subject <br />property, has made application pursuant to Section 40.2-533 of the Code of the City of <br />Portsmouth, Virginia for the granting of a use permit for a warehouse and light <br />manufacturing use at 1050 University Boulevard (Tax Parcel 0833-0017); and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br /> <br /> <br /> <br />
