June 13, 2023 At a Regular Meeting of the City Council on Tuesday, June 13, 2023, there were present: Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. Mark M. Whitaker, De’Andre A. Barnes, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City Manager Mimi C. Terry, City Attorney Lavonda Graham-Williams. Mayor Glover asked for a moment of silence which was followed by the Pledge of Allegiance to the Flag. Mayor Glover called the meeting to order and welcomed all in attendance. Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of a Called Meeting of May 23, 2023, and of a Regular Meeting of May 23, 2023, and was adopted by the following vote: Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None - Public Hearing - 23 - 204 - Public hearing on use permit and rezoning applications: (a) UP-23-07 COMMERCIAL DISTRICT 3 - Resolution granting the request of Ron Holloway, with New Home Builders, for a Use Permit to construct four (4) townhouses on the approximately 0.231 combined acres located at 3002 and 3006 Deep Creek Boulevard in the General Mixed-Use (GMU) zoning district. The Future Land Use Map of the Build One Portsmouth Comprehensive Plan designates these properties for Multi-Family Residential. The properties are owned by New Home Builders. Planning Commission recommends approval with amended conditions. 1. Ronald Holloway, 1208 Copper Stone Circle, Chesapeake, presented the application. Motion by Mr. Moody, and seconded by Mr. Barnes, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION GRANTING A USE PERMIT (UP-23-07) TO NEW HOME BUILDERS INC. TO CONSTRUCT FOUR (4) TOWNHOUSES AT 3002 AND 3006 DEEP CREEK BOULEVARD (TAX PARCELS 0145-0190 AND 0145-0200). WHEREAS , New Home Builders Inc., the owner of the subject property, has made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit to construct four (4) townhouses at 3002 and 3006 Deep Creek Boulevard (Tax Parcels 0145-0190 & 0145-0200); and WHEREAS , the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS , the Planning Commission has recommended the approval of the application for a use permit. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it has reviewed and considered the application materials, the City staff report, the proceedings and recommendation of the Planning Commission, all comments made at the public hearing, and the discussion of the Council regarding the application.
