May 23, 2023 <br /> <br />(b) Prior to obtaining a Certificate of Occupancy and for so long as the child day center <br />use continues on the property, the owners and/or operators shall install and maintain <br />digital video equipment with recording capabilities sufficient to indicate the date and time <br />that the recording is made. The recording shall provide surveillance coverage <br />encompassing the front, side, and rear exteriors of the building housing the use for 24 <br />hours a day, 7 days a week. Recorded data must be maintained in a condition permitting <br />review of the information for a period of no less than thirty days. <br /> <br />(c) Prior to initially operating the child day center use a Zoning Permit must be <br />obtained from the City’s Zoning Administrator and a Certificate of Occupancy must be <br />obtained from the Department of Permits and Inspections. <br /> <br />(d) For any proposed development associated with the subject property, a site plan <br />must be submitted to the Engineering Department for review and approval as and to the <br />extent required by the Zoning Ordinance or the City Code. <br /> <br />(e) All proposed development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to the commencement of any development <br />and the operation of the child day center use, and shall be maintained during the operation <br />of the use. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(g) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br />REVOCATION OF PERMIT: <br />7. Without limitation, violation of any of the <br />conditions set forth herein may serve as grounds for revocation of the use permit by City <br /> <br />Council. See Section 40.2-533(L) of the Zoning Ordinance.” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />(b) UP-23-03 WEST NORFOLK - Resolution granting the request of James <br />Stevens, with PortRail Crane Service, for a Use Permit to operate <br />a shipping container storage yard on approximately 1.4 combined <br />acres located at 3301 Mariner Avenue, 3300 West Norfolk Road, <br />3324 West Norfolk Road, and 3303 Broadway Street in the Light <br />Industrial (IL) zoning district. The Future Land Use Map of the Build <br />One Portsmouth Comprehensive Plan designates this property for <br />Light Industrial use. The property is owned by Roger and Glena <br />Woodington. Planning Commission recommends approval with <br />conditions. <br /> <br />1. Dan Stevens, 3301 Mariner Avenue, presented the application. <br /> <br />2.
