<br />At a Regular Meeting of the City Council on Tuesday, May 23, 2023, there were  
<br />present:

<br />Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr.  
<br />Mark M. Whitaker, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City Manager Mimi C.  
<br />Terry, City Attorney Lavonda Graham-Williams.  
<br />  
<br />Mayor Glover asked for a moment of silence which was followed by the Pledge of  
<br />Allegiance to the Flag.  
<br />  
<br /> Mayor Glover called the meeting to order and welcomed all in attendance.  
<br />  
<br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of  
<br />a Special Called Meeting of May 8, 2023, of a Called Meeting of May 9, 2023, and of a  
<br />Regular Meeting of May 9, 2023, and was adopted by the following vote:

<br />Ayes:   Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover  
<br />Nays:   None   
<br />  
<br />- Public Hearing -  
<br />  
<br />23 - 176 - Public hearing on use permit and rezoning applications:  
<br />  
<br />(a)  UP-23-02  CARNEY FARM - Resolution granting the request of Nicole Clay,  
<br />with Deep Creek Academy, for a Use Permit to operate a child day  
<br />center on approximately 6.5 acres located at 4710 High Street West  
<br />in the General Residential (GR) zoning district. The Future Land Use  
<br />Map of the Build One Portsmouth Comprehensive Plan designates  
<br />this property for Institutional/Public use. The property is owned by  
<br />Fred Riley and other Trustees. Planning Commission recommends  
<br />approval with conditions.  
<br />  
<br />1. Marsha Goodman, 3405 Winterhawk Court, Chesapeake, presented the application.  
<br />  
<br />Motion by Mr. Hugel, and seconded by Ms. Lucas-Burke, to adopt the following  
<br />resolution, and was adopted by the following vote:  
<br />  
<br />“RESOLUTION GRANTING A USE PERMIT (UP-23-02) TO OPERATE A CHILD DAY  
<br />CENTER AT 4710 HIGH STREET WEST (TAX PARCEL 0759-0010). 
<br />  
<br />  
<br />WHEREAS 
<br /> , Deep Creek Baptist Church, the owner of the subject property, has  
<br />made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth,  
<br />Virginia for the granting of a use permit to operate a child day center at 4710 High Street  
<br />West (Tax Parcel 0759-0010); and   
<br />  
<br />WHEREAS 
<br /> , the applicant and the Planning Director have done all things required  
<br />to be done in connection with the application; and  
<br />  
<br />WHEREAS 
<br /> , the Planning Commission has recommended the approval with  
<br />conditions of the application for a use permit.  
<br />  
<br />NOW THEREFORE BE IT RESOLVED  
<br /> by the Council of the City of Portsmouth,  
<br />Virginia:  
<br />  
<br /> 1.   That it has reviewed and considered the application materials, the City staff  
<br />report, the proceedings and recommendation of the Planning Commission, all comments  
<br />made at the public hearing, and the discussion of the Council regarding the application.  
<br />  
<br /> 2. That it has considered factors it deemed applicable and consistent with the  
<br />Code of Virginia, which may include, without limitation, the nature, extent, external effects,  
<br />location, design or method of operation of the requested use, the City’s comprehensive  
<br />plan, and the public health, safety, and general welfare.
