May 23, 2023 WHEREAS, the City and its consultant have determined that the required repairs are anticipated to cost at least $544,00 (subject to additional modifications which may be necessary based on continued evaluation of the structure); and WHEREAS, the original contract price for performance of the Work was $1,376,000; and WHEREAS, the change to the project scope to address the newly discovered deterioration and environmental concerns and will result in additional material and construction costs that will exceed 25% of the original contract amount; and WHEREAS, Section 12-183 of the City Code requires Council approval to exceed an original contract amount by more than 25% or $50,000, whichever is greater; and WHEREAS, it is projected that the final project cost will be approximately $1,920,000, and funding to complete the project is available through the Community Development Block Grant program and the Capital Improvement Fund. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that, pursuant to Section 12-183 of the City Code, the City Manager is authorized to expend the additional funds necessary to address the newly discovered deterioration and environmental concerns, and to complete the Elm Avenue Neighborhood Facility Renovation and HVAC Improvement Project.” Ayes: Hugel, Lucas-Burke, Moody, Tillage, Glover Nays: Whitaker 23 - 187 - Adoption of a resolution authorizing the grant of a variable width utility easement to Virginia Electric and Power Company across a portion of Tax Parcel 0587-0010 at Manor High School. Background:  Portsmouth Public Schools (PPS) intends to install a charging station at the bus parking lot located at Manor High School.  To install the charging station, it is necessary to provide Dominion (Virginia Electric and Power Company) a small variable width utility easement across Tax Parcel 0587- 0010, which is owned by the City. Discussion:  City staff has reviewed the location of the proposed easement and determined that it will not have a negative impact on any City facilities. Financial Impact:  None. Recommended Action:  Adoption of the resolution. Next Steps Following Council Action:  The City Manager will execute and deliver the requested easement. Motion by Ms. Lucas-Burke, and seconded by Mr. Tillage, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION AUTHORIZING THE GRANT OF A VARIABLE WIDTH UTILITY EASEMENT TO VIRGINIA ELECTRIC AND POWER COMPANY ACROSS A PORTION OF TAX PARCEL 0587-0010 AT MANOR HIGH SCHOOL.
