March 14, 2023 <br /> <br />WHEREAS <br /> , Portsmouth-Afton Square LP, the owner of the subject property, has <br />consented to the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That Community Housing Partners Corporation is hereby granted a use <br />permit pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia to <br />construct and operate a two-building multifamily dwelling development having not to <br />exceed 39 total units at 2216 Waldron Avenue and 2220 Waldron Avenue (Tax Parcels <br />0465-0380 and 0465-0390), being more particularly described as: <br /> <br />UP-22-22 <br /> <br />2216 Waldron Avenue <br />(Tax Parcel 0465-0390) <br />2220 Waldron Avenue <br />(Tax Parcel 0465-0380) <br /> <br />ALL THOSE certain pieces, parcels, sections or lots of land, together with the easements <br />and appurtenances belonging thereto, situate in the City of Portsmouth, Virginia, and <br />being known, numbered and designated as the Eastern 180.00 feet of Lot (Section) 2 and <br />all of Lots (Sections) 3, 4, 5, 6 and 7, in Block K, as shown on the map entitled “Plat of <br />Garden Homes”, recorded in the Clerk’s Office of the Circuit Court of the City of <br />Chesapeake, Virginia, in Map Book 21, at Pages 68 and 69, the Southwest corner of such <br />property being a point on the North side of Waldron Avenue 60.00 feet East of Third Street <br />(now called Raven Street) together with all the right, title and interest appertaining thereto <br />in and to the platted lane designated as Waldron Avenue on the aforesaid plat, adjacent <br />to and south of the said property. <br /> <br />IT BEING Parcel Two of that certain property conveyed by Deed of Assumption between <br />Greenbrier Woods Corporation and Portsmouth-Afton Square, LP dated November 7, <br />2002 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />020035943. <br /> <br /> 6.
