March 14, 2023 <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, currently known as 1820 Prentis Avenue, situate, lying and being in the City of <br />Portsmouth, State of Virginia, designated as Disposition Parcel 3, Prentis Park <br />Conservation Project, as shown on that certain plat entitled “Plat Showing Survey of <br />Disposition Parcel 3, Prentis Park Conservation Project, Portsmouth, Virginia, for the <br />Portsmouth Redevelopment and Housing Authority,” made by AML Surveying, Mortgage <br />and Land Surveys, Portsmouth, Virginia, dated August 27, 1993 and recorded in the <br />Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia, in Deed Book 1114, <br />at page 1712. <br /> <br />IT BEING the same property conveyed to The L. Louise Lucas Trust by Deed from <br />Southside Direct Care Provider, L.L.C. dated December 24, 2009, and recorded in the <br />Clerk’s Office of the Circuit Court for the City of Portsmouth, Virginia as Instrument <br />Number 100000009. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Without limitation, the use shall maintain compliance with the following use-specific <br />standards set forth in Section 40.2-217(D)(2)(a) of the Zoning Ordinance: <br /> <br />“(i) In addition to general requirements, halfway houses shall comply with the standards <br />set forth by the Director of the Department of Corrections and the State Board of <br />Corrections”. <br /> <br />(b) No more than eight (8) halfway house residents shall reside at the property at one <br />time and a minimum of one (1) “House Manager” shall reside at the property at all times. <br /> <br />(c) Prior to Zoning Permit issuance, a Minor Subdivision Plat must be approved by the <br />City and recorded to vacate the lot lines between 1810 Prentis Avenue (Tax Parcel 0069- <br />0230), 1816 Prentis Avenue (Tax Parcel 0069-0240), and 1820 Prentis Avenue (Tax <br />Parcel 0069-0220) and combine them into a single parcel. The Plat must comply with the <br />applicable requirements of Chapter 33.1 (Subdivisions) of the City Code. <br /> <br />(d) Prior to initiating the use, a Zoning Permit from the City Zoning Administrator and <br />a Certificate of Occupancy from the City Department of Permits and Inspections must be <br />obtained. <br /> <br />(e) The occupancy of the halfway house must at all times be in compliance with the <br />maximum occupancy load limits established by the Building Official. <br /> <br />(f) The use shall be conducted in compliance with all applicable codes, ordinances <br />and regulations of federal, state, and local government, and all required licenses and <br />permits shall be obtained and maintained in good standing during the operation of the <br />use. <br /> <br />(g) Prior to initiating the use and so long as the use remains in operation, the owners <br />and/or operators shall install and maintain digital video equipment with recording <br />capabilities sufficient to indicate the date and time that the recording is made. The <br />recording shall provide surveillance coverage encompassing the front, side, and rear <br />exteriors of the establishment for 24 hours a day, 7 days a week. Recorded data must <br />be maintained in a condition permitting review of the information for a period of no less <br />than thirty days. <br /> <br />(h) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(i) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br /> <br /> <br /> <br /> <br />
