February 14, 2023 <br /> <br />(b) This Use Permit approval is only applicable to Suite 102 on the property, as <br />currently configured. The approved use shall not be operated in any other suite on the <br />property. <br /> <br />(c) Without limitation, the use shall be operated in compliance with the following use- <br />specific standard set forth in Section 40.2-217(G)(7)(a): <br />(i) All newly established new and used vehicle sales uses shall be prohibited from <br />parking or displaying vehicles in the required buffer between the front lot line and any <br />vehicle use area. <br /> <br />(d) A Zoning Permit must be obtained from the City’s Zoning Administrator and a <br />Certificate of Occupancy (CO) must be obtained from the City Department of Permits and <br />Inspections prior to initially operating the approved use. <br /> <br />(e) The use shall be operated in accordance with the maximum occupancy load limits, <br />including patrons and employees, set by the City Building Official. <br /> <br />(f) Outdoor storage is not permitted. <br /> <br />(g) All vehicles shall be parked behind the front façade of the building out of which the <br />use is being operated. No U-Haul (or other self-hauling) vehicles shall be parked in the <br />off-street parking spaces that are required under the Zoning Ordinance to serve the other <br />established uses on the property. <br /> <br />(h) All local, state, and federal licenses and permits required for operation of the <br />establishment shall be obtained and maintained in good standing. <br /> <br />(i) Prior to initially operating the approved use and so long as the use remains in <br />operation, the owners and/or operators shall install and maintain digital video equipment <br />with recording capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the front, side, <br />and rear exteriors of the establishment for 24 hours a day, 7 days a week. Recorded data <br />must be maintained in a condition permitting review of the information for a period of no <br />less than thirty days. <br /> <br />(j) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(k) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br />REVOCATION OF PERMIT: <br />7. Without limitation, violation of any of the <br />conditions set forth herein may serve as grounds for revocation of the use permit by City <br /> <br />Council.
