February 14, 2023 <br /> <br />At a Regular Meeting of the City Council on Tuesday, February 14, 2023, there <br />were present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. <br />Mark M. Whitaker, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City Manager Mimi C. <br />Terry, City Attorney Lavonda Graham-Williams. <br /> <br />Mayor Glover asked for a moment of silence which was followed by the Pledge of <br />Allegiance to the Flag. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of <br />a Called Meeting of January 24, 2023, and of a Regular Meeting of January 24, 2023, <br />with amended changes, and was adopted by the following vote: <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- Presentation - <br /> <br /> <br /> Presentation of a proclamation for “Million Hearts Blood Pressure Control Week”. <br /> <br />- Public Hearing - <br /> <br />23 - 45 - Public hearing on use permit applications: <br /> <br />(a) UP-22-18 PRENTIS PARK - Resolution granting the request of AEK1 <br />Construction Inc for a Use Permit for a vehicle sales use to rent U- <br />Haul vehicles and sell moving supplies on the 0.69-acre property at <br />1820 Elm Avenue in the Neighborhood Mixed-Use (NMU) zoning <br />district. The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property for Commercial. The <br />property is owned by Elkhart Assisted Living LLC. Planning <br />Commission recommends approval with conditions. <br /> <br />1. Valencia Kelly, 2506 Walnut Street, presented the application. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Dr. Whitaker, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-22-18) TO AEK1 CONSTRUCTION <br />INC. FOR A VEHICLE SALES USE TO RENT U-HAUL VEHICLES AND SELL MOVING <br />SUPPLIES AT 1820 ELM AVENUE (TAX PARCEL 0085-1190). <br /> <br /> <br />WHEREAS <br /> , AEK1 Construction Inc. has made application pursuant to Section <br />40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit <br />for a vehicle sales use to rent U-Haul vehicles and sell moving supplies at 1820 Elm <br />Avenue (Tax Parcel 0085-1190); and <br /> <br />WHEREAS <br /> ,Elkhart Assisted Living LLC, the owner of the subject property, has <br />consented to the filing of the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> <br /> <br /> <br /> <br />
