February 14, 2023 At a Regular Meeting of the City Council on Tuesday, February 14, 2023, there were present: Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. Mark M. Whitaker, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City Manager Mimi C. Terry, City Attorney Lavonda Graham-Williams. Mayor Glover asked for a moment of silence which was followed by the Pledge of Allegiance to the Flag. Mayor Glover called the meeting to order and welcomed all in attendance. Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of a Called Meeting of January 24, 2023, and of a Regular Meeting of January 24, 2023, with amended changes, and was adopted by the following vote: Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None - Presentation -  Presentation of a proclamation for “Million Hearts Blood Pressure Control Week”. - Public Hearing - 23 - 45 - Public hearing on use permit applications: (a) UP-22-18 PRENTIS PARK - Resolution granting the request of AEK1 Construction Inc for a Use Permit for a vehicle sales use to rent U- Haul vehicles and sell moving supplies on the 0.69-acre property at 1820 Elm Avenue in the Neighborhood Mixed-Use (NMU) zoning district. The Future Land Use Map of the Build One Portsmouth Comprehensive Plan designates this property for Commercial. The property is owned by Elkhart Assisted Living LLC. Planning Commission recommends approval with conditions. 1. Valencia Kelly, 2506 Walnut Street, presented the application. Motion by Ms. Lucas-Burke, and seconded by Dr. Whitaker, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION GRANTING A USE PERMIT (UP-22-18) TO AEK1 CONSTRUCTION INC. FOR A VEHICLE SALES USE TO RENT U-HAUL VEHICLES AND SELL MOVING SUPPLIES AT 1820 ELM AVENUE (TAX PARCEL 0085-1190). WHEREAS , AEK1 Construction Inc. has made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit for a vehicle sales use to rent U-Haul vehicles and sell moving supplies at 1820 Elm Avenue (Tax Parcel 0085-1190); and WHEREAS ,Elkhart Assisted Living LLC, the owner of the subject property, has consented to the filing of the application; and WHEREAS , the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS , the Planning Commission has recommended the approval with conditions of the application for a use permit. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
