January 10, 2023 <br /> <br />23-19b: <br /> <br />Motion by Mr. Hugel, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF STORMWATER <br />GENERAL OBLIGATION BONDS BY THE CITY OF PORTSMOUTH, VIRGINIA, AND <br />ESTABLISHING THE TERMS, DETAILS, AND PROVISIONS FOR THE PAYMENT <br />THEREOF (STORMWATER GENERAL OBLIGATION BONDS; TOTAL PRINCIPAL <br />AMOUNT NOT TO EXCEED $2,900,000).” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />23 - 20 - Adoption of a resolution initiating an amendment to the Portsmouth Zoning <br />Ordinance to allow City Council to elect to reconsider denied zoning applications. <br /> <br />Background: <br /> <br /> Currently, the Portsmouth Zoning Ordinance requires a one-year waiting period <br />before applications for a Use Permit or Rezoning that are denied by City Council can be <br />resubmitted. <br /> <br /> The Virginia Code authorizes, but does not mandate, this waiting period. <br /> <br /> Other localities use different approaches. For example, the Suffolk Zoning <br />Ordinance establishes a similar one-year waiting period but allows City Council to vote to <br />reconsider a denial during the waiting period. <br /> <br />Discussion: <br /> <br /> The Resolution proposed for Council consideration would initiate the process to <br />amend the Zoning Ordinance to grant City Council the flexibility to reconsider denied <br />applications prior to the end of the one-year waiting period. <br /> <br /> If the Resolution is adopted, Planning Department staff and the Office of the City <br />Attorney will work to draft a proposed amendment, which would then be presented to and <br />considered by Planning Commission and City Council. <br /> <br /> Any amendment proposed as a result of this Resolution will be subject to public <br />input, including through the formal public hearing process before the Planning <br />Commission and City Council required by the Virginia Code, and will not have legal effect <br />until the specific language of the amendment is approved by City Council. <br /> <br />Financial impact: <br /> <br /> N/A <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> Staff will prepare a draft amendment and present the proposed language to <br />Planning Commission and City Council for public hearings and deliberation. <br /> <br />Motion by Mr. Hugel, and seconded by Mr. Tillage, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION INITIATING AN AMENDMENT TO THE PORTSMOUTH ZONING <br />ORDINANCE TO ALLOW CITY COUNCIL TO ELECT TO RECONSIDER DENIED <br />ZONING APPLICATIONS. <br /> <br />WHEREAS, <br /> in furtherance of the general welfare and good zoning practice it is <br />advisable to review and amend the Portsmouth Zoning Ordinance (Chapter 40.2 of the <br />City Code) from time to time; and <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
