<br />At a Regular Meeting of the City Council on Tuesday, October 25, 2022, there were
<br />present:

<br />Mayor Shannon E. Glover, Vice Mayor De’Andre A. Barnes, William E. Moody, Jr., Lisa
<br />L. Lucas-Burke, Dr. Mark M. Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City
<br />Manager Tonya D. Chapman, Deputy City Attorney Jeff S. Miller.

<br />Mayor Glover asked for a moment of silence which was followed by the Pledge of
<br />Allegiance to the Flag.
<br />
<br /> Mayor Glover called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Woodard, and seconded by Mr. Moody, to adopt the minutes of a
<br />Called Meeting of October 11, 2022, and of a Regular Meeting of October 11, 2022, and
<br />was adopted by the following vote:

<br /> Presentation of the Sam T. Barfield Award of Excellence to Franklin Edmondson,
<br />Commissioner of the Revenue.

<br />- Public Hearing -

<br />22 - 305 - Public hearing on a use permit application:
<br />
<br />UP-22-12 UPTOWN - Resolution granting the request of Green Re-Leaf LLC
<br />for a Use Permit for an urban agriculture facility to grow and cultivate
<br />industrial hemp on an approximately 1.45-acre property located at
<br />1300 High Street in the Neighborhood Mixed-Use (NMU) zoning
<br />district and the Innovation Overlay District. The Future Land Use Map
<br />of the Build One Portsmouth Comprehensive Plan designates this
<br />property for Commercial use. The property is owned by Cars 4 Less,
<br />Inc. Planning commission recommends denial. Deferred from the
<br />October 11, 2022, City Council meeting.

<br />Motion by Ms. Lucas-Burke, and seconded by Mr. Battle, to adopt the following
<br />resolution, and was adopted by the following vote:

<br />“RESOLUTION GRANTING A USE PERMIT (UP-22-12) TO GREEN RE-LEAF LLC TO
<br />OPERATE AN URBAN AGRICULTURE FACILITY AT 1300 HIGH STREET (TAX
<br />PARCEL 0038-1330).

<br /> , Green Re-Leaf LLC has made application pursuant to Section 40.2-
<br />533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit to
<br />operate an urban agriculture facility at 1300 High Street (Tax Parcel 0038-1330); and
