June 14, 2022 <br /> <br />To find the Point of Beginning, commence at the northern intersection of the rights of way <br />of Stamford Road and Churchland Boulevard and run along Churchland Boulevard as <br />follows: N41 degrees 57’ 15” W-177.34 feet; N26 degrees 41’ 10” W-27.23 feet; N26 <br />degrees 11’ 11” W-70.51 feet; N40 degrees 42’06” W-85.95 feet to an iron at the Point of <br />Beginning; thence from said Point of Beginning running along the right-of-way of <br />Churchland Boulevard as follows; N40 degrees 42’06” W-35.54 feet to a monument; N41 <br />degrees 37’48” W-5.20 feet to a monument; N41 degrees 56’19”W-145.76 feet to an iron; <br />thence turning and running along parcel C1-Churchland GDS, LLC from iron to iron as <br />follows: N48 degrees 03’41” E-177.95 feet; S41 degrees 56’19” E-186.50 feet; S48 <br />degrees 03’41” W-178.75 feet to the Point of Beginning. <br /> <br />IT BEING all that certain property conveyed to Churchland Holdings Group, LLC by Deed <br />from Churchland GDS, LLC dated January 12, 2007 and recorded in the Clerk’s Office of <br />the Circuit Court for the City of Portsmouth, Virginia as Instrument Number 070002172. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Prior to initially operating the proposed event space/banquet hall, the owners <br />and/or operators of the establishment shall obtain a Certificate of Occupancy. Any <br />maximum occupancy load limits set by the Building Official, including patrons and <br />employees, shall be strictly complied with in the operation of the event space/banquet hall <br />establishment. <br /> <br />(b) Prior to initially operating the event space/banquet hall, the owners and/or <br />operators of the establishment shall obtain the required permits for all improvements <br />performed to the interior and exterior of the commercial space, including signage. The <br />event space/banquet hall shall be constructed and operated in compliance with applicable <br />codes, ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and maintained in effect during operation of the <br />establishment. <br /> <br />(c) The proposed development shall comply with Portsmouth City Code 40.2- <br />217(G)(4)(b) – Use Specific Standards for Specific Commercial Uses – Entertainment <br />Establishment (Indoor and Outdoor): (i) Entertainment Establishments shall not create <br />unreasonable environmental aspects such as noise, odor, smoke, vibration, heat, or <br />glare; (ii) Noise from the establishment shall comply with City Code Sec. 24-255 Unlawful <br />Excessive Sound; and (iii) Any building housing live entertainment shall include <br />soundproof entryway and exit doors. <br /> <br />(d) The event space/banquet hall shall comply with Portsmouth City Code 40.2-301 – <br />Off-Street parking, Loading, and Circulation and provide, at least, fifteen (15) off-street <br />vehicle parking spaces and two (2) bicycle parking spaces. <br /> <br />(e) Rear doors shall be used for emergency exits and deliveries only, and shall not be <br />propped open during hours of operation. <br /> <br />(f) The fenced open area abutting the establishment shall not be utilized for additional <br />outdoor event space. <br /> <br />(g) Prior to initially operating the event space/banquet hall establishment and so long <br />as the establishment remains in operation, the owners and/or operators of the <br />establishment shall install and maintain digital video equipment with recording capabilities <br />sufficient to indicate the date and time that the recording is made. The recording shall <br />provide surveillance coverage encompassing the front, side, and rear exteriors of the <br />establishment during the operating hours of the establishment and for at least one <br />additional hour after the close of business. Recorded data must be maintained in a <br />condition permitting review of the information for a period of no less than thirty days. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
