March ll, 1986 <br /> <br />if) "A RESOLUTION APPROVING A CONSERVATION PLAN FOR THE BRIGHTON CONSERVATION PROJECT. <br /> <br /> WHEREAS, under the provisions of the Housing and Community Development Act of 1974, as <br />amended, financial assistance is provided to localities for undertaking and carrying out commu: <br />nity development activities, including the execution of conservation profects; and <br /> <br /> WHEREAS, said conservation projects must be approved by the governing body of the localit <br />in whiah the project is. situated pursuant to Title 36 of the Code of Virginia, 1950, as amende <br />and that such approval must include findings by the governing body that: <br /> <br /> 1. The Conservation Plan will afford maximum opportunity consistent with the sound needs <br />of the locality as a whole, for conservation of the project area by private and/or public <br />enterprise; and <br /> <br /> 2. That Conservation Plan conforms to the general plan for the development of the local] <br />as whole; and <br /> <br /> ~ WHEREAS~ a plan identified as the Conservation Plan for the Brighton'Conservation Project <br />[hereinafter referred to as the "Plan"), dated February 1986, and consisting of four (4) <br />pages and two (2) exhibits and has been referred to this Council for review and approval; and <br /> <br /> WHEREAS, the Plan for the conservation project identified as the Brighton Conservation <br />District (hereinafter call the "Project"), encompasses the area as described in the boundary <br />description within the Plan in the City of Portsmouth, State of Virginia (hereinafter called <br />lie "Locality"), and delineated on the attached exhibit; and <br /> <br /> WHEREAS, a study of the project area has been made and <br />area ~s deteriorating and eligible for conservation pursuant <br />Virginia; and <br /> <br />it has been determined that the <br />to Title 36 of the Code of <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has resolved that this Plan is in <br />the best interest of the City's renewal effort; and <br /> <br /> WHEREAS, this Council is cognizant of the conditions that are imposed by the provisions <br />of the Housing and Community Development Act of 1974, as amended, including those prohibiting <br />descrimination on the basis of race, age, color, creed, sex or national origin; and <br /> <br /> WHEREAS, in the judgment of this Council, it is in the interest of the City and its in- <br />habitants that the said plan be approved. <br /> <br />THEREFORE, B~ IT RESOLVED by the Council of the City of Portsmouth: <br /> <br /> 1. That it is hereby deemed appropriate and in the public interest that a conservation <br />program be carried out in the Brighton neighborhood within the boundaries described in the <br />Brighton Conservation Plan. <br /> <br /> 2. That it is hereby found and determined that the Plan for the project area will afford <br />maximum opportunity, consistent with the needs of the City of Portsmouth as a whole, for the ~ <br />conservation of the area and the Project qualifies as an eligible Conservation Project under <br />Title 36 of the Code of Virginia, 1950, as amended. <br /> <br /> 3. That, in order to implement and facilitate the effectuation of the Plan, this Council <br />hereby (a) pledges its cooperation in the execution of the Plan; (b) requests the various <br />offidiRls.,~ departments, boards and agencies of the City of Portsmouth having administrative <br />responsibilities likewise to cooperate to such end and to exercise their respective functions <br />and powers in a manner consistent with the Plan; (c) acknowledges that conservation measures <br />and other activities described within the Plan will be carried Out in accordance with the <br />availability of funds; and (d) stands ready to consider and take appropriate action upon pro- <br />posals and measures designed to effectuate the Plan. <br /> <br /> 4. That the Plan for the project, having been duly reviewed and considered, is hereby <br />approved, and the City Clerk be, and is hereby directed to file said copy of the Plan with the <br />minutes of this meeting.'! <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Whitlow, Holley <br />Nays: None <br /> <br /> On of Mr. Corprew and seconded by Mr. Gray, the following resolution was adopted, and by <br />the following vote: <br /> <br />(g) "A RESOLUTION APPROVING A CONSERVATION PLAN FOR THE PRENTIS PARK CONSERVATION <br /> PROJECT. <br /> <br /> WHEREAS, under the provisions of the Housing and Community Development Act of 1974, as <br /> amended, financial assistance is provided to localities for undertaking and carrying out <br />Fommunity development activities, including the execution of conservation projects; and <br /> <br /> WHEREAS, said conservation projects must be approved by the governing body of the localit <br />in which the project is situated pursuant to Title 36 of the Code of Virginia, 1950, as amende <br />and!thktlsnch approval must include findings by the governing body that: <br /> <br /> 1.
