March 22, 2022 <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />22 - 89 - Adoption of a resolution approving a Memorandum of Agreement with the <br />City of Chesapeake authorizing mutual limited occupancy of rights-of-way and a <br />limited fiber strand exchange. <br /> <br />Background: <br /> <br /> The City has designed and constructed a fiber network ring to, among other <br />purposes, provide resiliency and ensure service availability to municipal operations. <br /> <br /> A small portion of the Portsmouth ring has been constructed within City of <br />Chesapeake right-of-way (“ROW”). Portsmouth must obtain permission from <br />Chesapeake to occupy Chesapeake’s ROW. <br /> <br /> Chesapeake is also planning to construct its own fiber ring network to serve its <br />municipal needs. Chesapeake wants to build a small portion of its ring in Portsmouth’s <br />ROW. Chesapeake must obtain permission from Portsmouth to occupy Portsmouth’s <br />ROW. <br /> <br />Discussion: <br /> <br /> The proposed agreement will allow Portsmouth and Chesapeake to occupy each <br />other’s ROW at the specifically listed locations to complete their rings. This agreement is <br />beneficial to both cities, as the geography of the Portsmouth/Chesapeake border makes <br />it challenging to complete a ring without encroaching on the other jurisdiction. <br /> <br /> In addition, to better coordinate public safety resources, Portsmouth and <br />Chesapeake staff would like to connect Portsmouth’s and Chesapeake’s public safety <br />buildings through the fiber rings. Therefore, the attached agreement also includes a fiber <br />exchange between the two cities. Chesapeake grants Portsmouth access to 12 strands <br />of Chesapeake’s ring at specific locations, and Portsmouth grants Chesapeake access <br />to 12 strands of Portsmouth’s ring at specific locations. <br /> <br />Financial Impact: <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute the Agreement. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION APPROVING A MEMORANDUM OF AGREEMENT WITH THE CITY <br />OF CHESAPEAKE AUTHORIZING MUTUAL LIMITED OCCUPANCY OF RIGHTS-OF- <br />WAY AND A LIMITED FIBER STRAND EXCHANGE. <br /> <br /> WHEREAS, <br />the City has designed and constructed a fiber network ring; and <br /> <br />WHEREAS, <br />a small portion of the City’s ring has been constructed within the City <br />of Chesapeake’s right-of-way; and <br /> <br />WHEREAS, <br />the City of Chesapeake also intends to construct its own municipal <br />fiber network ring; and <br /> <br />WHEREAS, <br />a small portion of the Chesapeake ring will be constructed within the <br />City of Portsmouth’s right-of-way; and <br /> <br />WHEREAS, <br />the two Cities also intend to better coordinate public safety resources <br />by connecting their public safety buildings through the fiber network rings, which can be <br />accomplished through allowing each other access to fiber strands at specific locations; <br />and <br /> <br /> <br /> <br /> <br />
