March 8, 2022 <br /> <br />(b) Where required by the Zoning Ordinance, all external site and building <br />improvements, including signage, must be approved through issuance of a Certificate of <br />Appropriateness (COA) by the Downtown Design Committee (DDC) prior to the <br />commencement of work. <br /> <br />(c) Without limitation, prior to initially operating the entertainment establishment, a <br />new Zoning Permit must be obtained from the Zoning Administrator and a Certificate of <br />Occupancy (CO) must be obtained from the Department of Permits and Inspections. <br /> <br />(d) The maximum occupancy load of the entertainment establishment, including <br />patrons and employees, shall be in compliance with any limits set by the Building Official. <br /> <br />(e) The owners and/or operators of the establishment shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by any patrons or customers. If the Chief of Police, in their <br />discretion, determines that there are significant violations of this type so as to comprise a <br />significant law enforcement problem, they may notify the applicant in writing and provide <br />a copy of such notice to the Zoning Administrator, which may result in the initiation of <br />proceedings for the revocation of this Use Permit. This clause is not to be construed as <br />a limitation or waiver of any other grounds for revocation of this Use Permit under the <br />Zoning Ordinance or the terms hereof. <br /> <br />(f) All local, state and federal licenses and permits required for operation of the <br />entertainment establishment shall be obtained and maintained in good standing. <br /> <br />(g) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Whitaker, Woodard, Glover <br />Nays: Moody <br /> <br />(b) UP-22-02 HODGES MANOR - Resolution granting the request of Travis and <br />Toya, LLC, doing business as Notorious Lounge, for a Use Permit <br />for an entertainment establishment at 6263 Portsmouth Boulevard. <br />The property is zoned Neighborhood Mixed Use (NMU) and is <br />further identified as Tax Map 620, Parcel 2. The Generalized <br />Future Land Use Map of the Build One Portsmouth Comprehensive <br />Plan designates the parcel as part of a mixed-use corridor. <br />Planning Commission recommends approval with conditions. <br /> <br />1. Freddie Taylor, 5724 Hawthorne Lane, asked if the applicant was willing to make the <br />business a safe haven for youths in the community. <br /> <br />Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-22-02) TO TRAVIS AND TOYA, LLC <br />TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 6263 PORTSMOUTH <br />BOULEVARD (TAX PARCEL 0620-0020). <br /> <br /> <br />WHEREAS <br /> , Travis and Toya, LLC, the lessees of a portion of the subject property, <br />has made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, <br />Virginia for the granting of a use permit to operate an entertainment establishment at 6263 <br />Portsmouth Boulevard (Tax Parcel 0620-0020); and <br /> <br />WHEREAS <br /> , Manor Village, LLC, the owner of the subject property, has consented <br />to the application; and <br /> <br /> <br /> <br /> <br /> <br /> <br />
