March 8, 2022 At a Regular Meeting of the City Council on Tuesday, March 8, 2022, there were present: Mayor Shannon E. Glover, Vice Mayor De’Andre A. Barnes, William E. Moody, Jr., Lisa L. Lucas-Burke, Dr. Mark M. Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City Manager Angel L. Jones, Interim City Attorney Burle U. Stromberg. Mayor Glover asked for a moment of silence which was followed by the Pledge of Allegiance to the Flag. Mayor Glover called the meeting to order and welcomed all in attendance. Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of a Called Meeting of February 22, 2022, of a Regular Meeting of February 22, 2022, and of a Special Called Meeting of March 1, 2022, and was adopted by the following vote: Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None - Presentation -  Presentation of a proclamation for Girl Scout Week. - Public Hearing - 22 - 64 - Public hearing on use permit applications: (a) UP-22-01 DOWNTOWN - Resolution granting the request of Marlon Milligan, of Reality Property Group 757, for a Use Permit for an entertainment establishment in a restaurant and sports bar on a 0.087-acre parcel located at 600 Court Street in the Downtown D1-T4 Urban Center zoning sub-district. The Future Land Use Map of the Build One Portsmouth Comprehensive Plan designates this property as Mixed- Use Downtown. The property is owned by Louis Esther Corp. Planning Commission recommends approval with conditions. 1. Freddie Taylor, 5724 Hawthorne Lane, asked if the applicant was willing to make the business a safe haven for youths in the community. Motion by Dr. Whitaker, and seconded by Mr. Barnes, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION GRANTING A USE PERMIT (UP-22-01) TO MARLON MILLIGAN TO OPERATE AN ENTERTAINMENT ESTABLISHMENT IN A RESTAURANT AND SPORTS BAR AT 600 COURT STREET (TAX PARCEL 0013-0170). WHEREAS , Marlon Milligan, the lessee (or agent for the lessee) of the subject property, has made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit to operate an entertainment establishment in a restaurant and sports bar at 600 Court Street (Tax Parcel 0013-0170); and WHEREAS , Louis Esther Corporation, the owner of the subject property, has consented to the application; and WHEREAS , the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS , the Planning Commission has recommended the approval with conditions of the application for a use permit.
