March 8, 2022 <br /> <br />At a Regular Meeting of the City Council on Tuesday, March 8, 2022, there were <br />present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor De’Andre A. Barnes, William E. Moody, Jr., Lisa <br />L. Lucas-Burke, Dr. Mark M. Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City <br />Manager Angel L. Jones, Interim City Attorney Burle U. Stromberg. <br /> <br />Mayor Glover asked for a moment of silence which was followed by the Pledge of <br />Allegiance to the Flag. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of <br />a Called Meeting of February 22, 2022, of a Regular Meeting of February 22, 2022, and <br />of a Special Called Meeting of March 1, 2022, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />- Presentation - <br /> <br /> <br /> Presentation of a proclamation for Girl Scout Week. <br /> <br />- Public Hearing - <br /> <br />22 - 64 - Public hearing on use permit applications: <br /> <br />(a) UP-22-01 DOWNTOWN - Resolution granting the request of Marlon Milligan, <br />of Reality Property Group 757, for a Use Permit for an entertainment <br />establishment in a restaurant and sports bar on a 0.087-acre parcel <br />located at 600 Court Street in the Downtown D1-T4 Urban Center <br />zoning sub-district. The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property as Mixed- <br />Use Downtown. The property is owned by Louis Esther Corp. <br />Planning Commission recommends approval with conditions. <br /> <br />1. Freddie Taylor, 5724 Hawthorne Lane, asked if the applicant was willing to make the <br />business a safe haven for youths in the community. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Barnes, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-22-01) TO MARLON MILLIGAN TO <br />OPERATE AN ENTERTAINMENT ESTABLISHMENT IN A RESTAURANT AND <br />SPORTS BAR AT 600 COURT STREET (TAX PARCEL 0013-0170). <br /> <br /> <br />WHEREAS <br /> , Marlon Milligan, the lessee (or agent for the lessee) of the subject <br />property, has made application pursuant to Section 40.2-533 of the Code of the City of <br />Portsmouth, Virginia for the granting of a use permit to operate an entertainment <br />establishment in a restaurant and sports bar at 600 Court Street (Tax Parcel 0013-0170); <br />and <br /> <br />WHEREAS <br /> , Louis Esther Corporation, the owner of the subject property, has <br />consented to the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br /> <br /> <br /> <br /> <br /> <br />
