February 8, 2022 At a Regular Meeting of the City Council on Tuesday, February 8, 2022, there were present: Mayor Shannon E. Glover, William E. Moody, Jr., Lisa L. Lucas-Burke, Dr. Mark M. Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City Manager Angel L. Jones, Interim City Attorney Burle U. Stromberg. Mayor Glover asked for a moment of silence which was followed by the Pledge of Allegiance to the Flag. Mayor Glover called the meeting to order and welcomed all in attendance. Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to adopt the minutes of a Called Meeting of January 25, 2022, and of a Regular Meeting of January 25, 2022, and was adopted by the following vote: Ayes: Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None - Public Hearing - 22 - 35 - Public hearing on a use permit application: UP-21-18 MIDTOWN -Resolution granting the request ofRachael Copeland and Sean Cooper for a Use Permit for an entertainment establishment at 3112 High Street. The property is zoned General Mixed Use (GMU). The Generalized Future Land Use Map of the Build One Portsmouth Comprehensive Plan recommends commercial development for the parcel. Planning Commission recommends approval with conditions. 1. Rachael Copeland, 2317 Lloyd Drive, Chesapeake, VA, presented the application. Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following resolution and was adopted by the following vote: “RESOLUTION GRANTING A USE PERMIT (UP-21-18) TO RACHAEL COPELAND AND SEAN COOPER TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 3112 HIGH STREET (TAX PARCEL 0352-0360). WHEREAS , Rachael Copeland and Sean Cooper, the lessees of the subject property, have made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use permit to operate an entertainment establishment at 3112 High Street (Tax Parcel 0352-0360); and WHEREAS , K F & F Properties, the owner of the subject property, has consented to the application; and WHEREAS , the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS , the Planning Commission has recommended the approval with conditions of the application for a use permit. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it has reviewed and considered the application materials, the City staff report, the proceedings and recommendation of the Planning Commission, all comments made at the public hearing, and the discussion of the Council regarding the application.
